  1. MENTAL HEALTH IN A DEVOLVED SYSTEM OF GOVERNMENT IN KENYA A PAPER PRESENTED BY DR. DAVID M. KIIMADIRECTOR OF MENTAL HEALTHMINISTRY OF HEALTH DURING KENYA PSYCHIATRIC ASSOCIATION 5TH ANNUAL SCIENTIFIC CONFERENCE 13TH-15TH JUNE 2013 AT LA MADA HOTEL, NAIROBI

  2. INTRODUCTION • The promulgation of the new constitution of Kenya 2010 on 27th August 2010 culminated into a devolved system of government at national and county levels. • Kenya remains a unitary State with one national government and 47 county governments.

  3. The first general election under the new constitution was held on 4th march 2013 and a new government formed comprising 48 governments namely the national and the 47 county governments. • The fourth schedule of the constitution gives the distribution of functions between the national government and county governments. • The national government deals with national policies while the county governments are responsible for service delivery.

  4. MENTAL HEALTH AND CONSTITUTION • Chapter four –The Bill of Rights, of the constitution ,guarantees everyone including persons with mental disorders rights and fundamental freedoms. • Article 25 provides for the Bill of Rights which are non-derogable and may not be limited. • Article 43(1) states that: Every person has the right to the highest attainable standard of health, which includes the right to health care services… “inclusive of mental health”.

HEALTH FUNCTIONS NATIONAL GOVERNMENT LEVEL • National Health Policy formulation. • National Health Legislation formulation. • National Health Regulation. • National Health Standards and Guidelines formulation. • National Referral Health facilities. • Capacity building and technical assistance to county governments.

  6. LEVELS OF HEALTH CARE • LEVEL 4- National referral health services. (National referral facilities) • LEVEL 3- County referral health services. (County hospitals) • LEVEL 2- Primary care services.(Clinics, health centers, nursing/maternity homes) • LEVEL 1- Community health services.(Individuals, households, families and communities)

  7. MENTAL HEALTH SERVICES • Pursuant to adoption by World Health Assembly of the WHA 65.4 Resolution on Global Burden of Mental disorders and the need for a comprehensive, coordinated response from health and social sectors at country level, Kenya is obligated to implement the resolution.

  8. The World Health Organization during this years World Health Assembly (66th WHA) adopted the draft Comprehensive Mental Health Action Plan (2013-2020) to be implemented by member States. • Kenya participated in the process and will implement the plan.
