  2. Details • The court was called upon to consider the constitiuality of a number of instances, ruled on jointly, in which defenders were questioned. • “while in custody or otherwise deprived of thief freedom in any significant way”

  3. Background • Similarly, in Westover Vs. United States, the petitioner was arrested by the FBI, interrogated, and made to sign statements without being notified of his right to counsel.

  4. Self incrimination • This deals with amendment 5: shall be compelled in any criminal case to be a witness against him self

  5. Miranda wins!! • Provided guidelines for law enforcements when arresting and interrogating suspects. The suspects must be made aware of their right, before interrogation, to remain silent and to have an attorney.
