BROKER REQUIREMENTS • must comply with fingerprinting and Criminal Background Check regulations in order to provide broker services • must be committed to concepts of person centered planning (PCP) and self direction • must attend Broker Training Institute (BTI) offered by OPWDD and complete 3 additional trainings: • PCP • Self-Determination/Self Advocacy • Circles of Support NYS OPWDD Monthly Broker Training 10/27/11

WHO CAN BE A BROKER? • Parents, family members, human service professionals, self-advocates, and anyone else who is interested • Immediate family members and persons with clinical relationships with the individual may not be paid to provide broker services. • Medicaid Service Coordinators and residential or day habilitation staff who provide direct support to a person may notbe a paid broker for that individual. BROKER RESPONSIBILITIES • Person Centered Planning (PCP) – keeping the person at the center • Use and encourage person-first, self directed language • Work with individual and circle of support (COS) to develop and maintain self directed plan • Work with individual and COS to implement of self directed services • Facilitate self directed solutions NYS OPWDD Monthly Broker Training 10/27/11

TYPES OF BROKERS • Start up Broker • time limited • facilitates person centered planning (if not already developed) • assists the individual in design of the self directed plan • provides technical support to participant to develop plan and budget • completes CSS Plan/Budget document • teaches & supports individual, family & COS to understand responsibilities in self direction • Support Broker • ongoing • assists in implementation & maintenance of self directed plan • teaches & supports individual, family & COS to understand responsibilities in self direction • facilitates changes to plan & budget as requested NYS OPWDD Monthly Broker Training 10/27/11

Complete an agreement between participant & broker Facilitate PCP Assist with COS development Work with the participant to complete the CSS Plan (habilitative plan) Work with the participant to complete the CSS Budget supporting the Plan Assist with communication among stakeholders Stay connected to MSC, DDSO Liaison & the FMS Assist with self hired staff (if requested) ROLE OFSTART UP BROKER NYS OPWDD Monthly Broker Training 10/27/11

Assist with service documentation and Medicaid compliance after implementation & throughout plan Assist with understanding self directed process Facilitate PCP Assist with communication among stakeholders Assist participant with maintaining a healthy, active COS Attend ISP annual & semi-annual reviews and hab plan reviews (if held separately) Work with participant to maintain the CSS Plan/Budget, prepare amendments when necessary Stay connected with MSC, FMS & DDSO Liaison Assist with self hired staff issues (if requested) ROLE OFSUPPORT BROKER NYS OPWDD Monthly Broker Training 10/27/11

Ongoing BROKER Functions • Revisit PCP on a regular basis or as changes occur • Problem solve COS issues & challenges • Assist with restructuring of COS if needed • Facilitate discussions of risks & safeguards • Assist participant & COS with self directed language and information as needed, e.g., writing job descriptions • Reinforce RESPONSIBILITY as the cornerstone of self directed services • Stay informed about what’s current in self directed options NYS OPWDD Monthly Broker Training 10/27/11

Additional BROKER Functions • Assist with recruitment, hiring, training and management of self hired staff as requested • Teach participant & COS about OPWDD system, waiver services & other alternatives in self direction • Support the self directed nature of the plan • Identify potential conflicts of interest NYS OPWDD Monthly Broker Training 10/27/11

  13. CHOOSING A BROKER - Options Individuals with Consolidated Supports & Services (CSS Monthly), Portal or Portal-like plans may choose: • INDEPENDENT BROKER or • AGENCY BROKER NYS OPWDD Monthly Broker Training 10/27/11

Autonomous Can be full or part time Is selected by participant & COS Works by broker agreement Bills at rate that reflects his experience ($25 - $35 per hour) Has no backup Must manage own training requirements Must manage own service documentation within established timelines Must stay connected with CSS liaison INDEPENDENT BROKER NYS OPWDD Monthly Broker Training 10/27/11

  15. AGENCY BROKER • Works for the participant and the broker agency • Is supervised by agency staff • Bills at agency rate ($40 per hour) for services provided • Works by broker agreement (agency listed as broker) • Broker agency: • Maintains and manages the agency brokers’ training records • Can provide agency backup for the brokers on its staff NYS OPWDD Monthly Broker Training 10/27/11

  19. Broker Payment Process • Broker may not be paid for services provided prior to “Effective Start Date” on approved start-up broker price sheet or “Budget Effective As Of” date on approved CSS Plan/Budget price sheet. • Broker sends completed invoices to FMS after services have been delivered. Invoice must be signed by broker and participant/designee prior to submission. • Once appropriate documentation is received by FMS, the invoice is paid. NYS OPWDD Monthly Broker Training 10/27/11

Summary • Self directed services make a difference in the lives of people with developmental disabilities!!! • Brokers have an ESSENTIAL part to play • Participants seem to have higher levels of satisfaction with individualized services when they trust and work well with their brokers!
