  2. Legislative Changes • Race to the Top initiatives impacted Education Article 6-202 and COMAR 13A.07.02.01B • Significant impact on probationary period/non-tenured status for professional staff hired on or after July 1, 2010

  3. Non-Tenured Status • Historically, benefits of tenure granted on the last day of the second year in HCPSS with an option for a third year non-tenured status • Now, tenure granted after three years and based on the effective date with ability for tenured Maryland teachers new to HCPSS to earn tenure after one year if satisfactory

  4. Effective Date onor after July 1, 2010 • Conditional Staff on a Provisional Contract: Will receive tenure three years from the effective date pending satisfactory performance each year and completion of all other certification requirements. • Certificated Staff on a Regular Contract with no Prior Teaching Experience: Will receive tenure three years from the effective date pending satisfactory performance each year.

  5. Effective Date on or after July 1, 2010 • Certificated Staff on a Regular Contract with Tenure from another Maryland Public School System – Will receive tenure one year from the effective date pending satisfactory performance during the first year in HCPSS. Non-tenured status may be extended for a second year if not satisfactory at the conclusion of the first year in HCPSS; must demonstrate a strong potential for improvement.

  6. Effective Date on or before June 30, 2010 • Conditional Staff on a Provisional Contract – Will receive tenure two years from the effective date pending satisfactory performance each year and completion of all other certification requirements. • Certificated Non-Tenured Staff on a Regular Contract – Continue to work under the tenure requirements of the Regular Contract that was in place when he or she was hired.

  7. Effective Date on orbefore June 30, 2010 • Certificated Staff on a Regular Contract who Returned from a Leave of Absence - Most are considered tenured because the staff member was tenured and certificated when he or she went on leave. • Certificated Tenured Staff on a Regular Contract – Continue to be tenured and will be evaluated per the established HCPSS evaluation procedures.
