Introduction Background: December 7, 2010 – Board adopts Ordinance establishing a one-year moratorium on issuance of business tax receipts for new pain management clinics (PMCs) in unincorporated Orange County; staff report due to Board by July 12, 2011. March 2, 2011 – Law enforcement work group convenes to identify issues and strategies in resolving problems relating to prescription drug abuse

5. Introduction Background (cont’d): Spring 2011 – Law enforcement workgroup holds several meetings. April 6, 2011 - Mayor Jacobs forms the Healthcare and Pharmacy workgroup; workgroup approves resolution asking Legislature to adopt the PDMP May 6, 2011 -- Legislature approves HB 7095 which strengthens regulations relating to PMCs

Scott signs HB 7095 into law (ch. 2011-141, LOF) July 19, 2011 – First meeting of Mayor Teresa Jacobs’ Prescription Drug Task Force; two subcommittees are created Summer and Fall, 2011 – Subcommittees on Pharmacy & Health Care and Law Enforcement meet separately and jointly

Introduction Background (cont’d): October 31, 2011 – recommendations adopted by full Task Force Today – Consider Task Force priority recommendation and extend moratorium for 180 days during which time other recommendations can be brought to Board (Remaining Task Force recommendations will be brought to Board in early January 2012)

9. Summary Proposed Ordinance: ● Continues the moratorium on issuance of business tax receipts in unincorporated Orange County for new PMCs for an additional 180 days. ● Updates definitions: - PMC is as defined in state law and - Exemptions are the same as in state law.

10. Summary Proposed Ordinance (cont’d): ● Updates transfer language to allow an existing PMC in unincorporated Orange County to relocate to another location in unincorporated Orange County and transfer BTR

Summary Proposed Ordinance (cont’d): ●Provides moratorium will expire: - on June 12, 2012 (180 days); - on the effective date of a subsequently adopted ordinance addressing drug use and distribution; OR - at such time as the BCC receives the report from staff and votes to repeal this moratorium …whichever date comes first.

12. Summary Proposed Ordinance (cont’d): ● Continues to restrict hours of operation of existing PMC to 7 a.m. to 9 p.m. each day ●Continues prohibition on acceptance of cash only by existing PMC through the moratorium period

Requested Action • Board approve and adopt an ordinance: • Extending the moratorium on the issuance of business tax receipts for any new pain management clinic in unincorporated Orange County for a period of up to180 days; • Updating definitions and language; • Restricting hours of operation for existing clinics to 7 a.m. to 9 p.m.; and • Restricting existing clinics from requiring cash only payments from patients. • Ordinance effective date: December 15, 2011.
