14A Update - MDOT Calculations • Basis for 14a Calculations • Drain Code: Public Act 40 of 1956 • State Funding Appropriations: Act 51 of 1951, MCL 247.664a • Act 51 established the transportation fund and provides for its spending & administration of funds. • PA 327 of 1972 amends Act 51 including Section 14a. 14A Update - MDOT Calculations • Basis for 14a Calculations • Section 14a of amendatory 1972, PA 327 provides for the expenditures of funds allocated by the act to the Department of State Highways and to the county road commissions to pay the cost of drain assessments under the Drain code with respect to state and county highways • Section 14a of 1951, PA 51, as added by 1972, PA 327, is not an amendment to the Drain Code of 1956. 14A Update - MDOT Calculations • Apportionment Based on a Formula called 14a Calculations. • Benefits are based on a pro rata share of storm water runoff from highways in the district in direct portion to the entire district. • Supplemental Benefits • MDOT pays for improvements/construction methods that MDOT requires. • Requires agreement between MDOT and County Drain Commissioner.
