  2. Temporary Visas for RNsA Brief History • H-1 (1952-89) • H-1A (1990-95) • No Temporary Visa Category for All RNs • TNs for Canadian/Mexican RNs • H-1B Visas – BSN must be minimum entry requirement

  3. Procedure for Temporary Visas • TNs • Simple for Canadians • More Complex for Mexicans (Visa Required) • H-1Bs • Submit Labor Condition Application to DOL • Submit Petition (I-129) to Immigration Service • Change Status if RN in US – Non-immigrant visa if RN is abroad

  4. Wage & Posting Requirements • Obtain Prevailing Wage Determination from State Labor Department • Non-Union Hospitals – Posting for 10 business days (Monday – Friday only) • Unionized Hospitals – Serve “posting notice” on bargaining representative • Wait 30 days, then submit petition to Immigration Service

  5. Green Cards for RNsResiding In the US • Submit I-140 to USCIS, I-485 when PD is Current • RN must have CGFNS, NCLEX or License • Ability to Pay Letter from CFO • Work (EAD) and Travel Permits (AP) • When Must VisaScreen Be Submitted?

  6. Green Cards for RNsResiding Outside the U.S. • Submit Visa Petition (I-140) to USCIS • Include Ability to Pay Letter • CGFNS or NCLEX or RN license required • CGFNS/NCLEX Sites Abroad • National Visa Center (Portsmouth, NH) • U.S. Embassy or Consulate – Final Interview
