  1. Wyoming District Title III Directors Meeting Summer Camp August 2nd, 2011 Casper, WY New Information, Common Issues, Concerns, and Questions

  2. New Title III leadership at WDE • David Holbrook is now the Division Director for (Quality Instruction and Learning Team Division) QuILT, formerly Federal Programs and E, Q, and A. • [name] will be assuming the Title III responsibilities, but David will still be available as a resource.

  3. Wyoming Active ELL Identification and Reporting Guidebook • All districts need to follow WDE guidelines for identification and placement of students who need ELL services, including the Home Language Survey, English language proficiency screening assessment (W-APT), the state’s Annual English Language Proficiency Assessment (ACCESS for ELLs), and ELL services. • The 2011-12 version of the guidebook will be posted to the WDE website soon. • There are no significant changes to the guidebook this year.

  4. AMAO Questions • Last year (2009-2010) WDE did not make AMAO 1 determinations and used prior year AMAO 3 decisions because of waivers received from the US Department of Education, is WDE going to make AMAO 1 and/or AMAO 3 determinations this year? • YES, WDE is making AMAO determinations for all three AMAOs this year. The waivers for AMAO 1 & 3 were one year, one time waivers.

  5. AMAO Questions • What are the consequences when a Title III funded districts fails to meet AMAOs? According to Title III statute section 3122(b) (2) If a State educational agency determines, based on the annual measurable achievement objectives described in subsection (a), that an eligible entity has failed to make progress toward meeting such objectives for 2 consecutive years, the agency shall require the entity to develop an improvement plan that will ensure that the entity meets such objectives. The improvement plan shall specifically address the factors that prevented the entity from achieving such objectives.

  6. AMAO Questions • If a State educational agency determines that an eligible entity has failed to meet the annual measurable achievement objectives described in subsection (a) for 4 consecutive years, the agency shall: • (A) require such entity to modify the entity's curriculum, program, and method of instruction; or • (B) (i) make a determination whether the entity shall continue to receive funds related to the entity's failure to meet such objectives; and (ii) require such entity to replace educational personnel relevant to the entity's failure to meet such objectives.

  7. AMAO Questions • Are AMAOs applied to all districts, or only districts that receive Title III funds? WDE has decided to make AMAO determinations for all school districts, but only to hold accountable those districts that received Title III funds. Therefore, all districts receive notification of AMAO determinations so they can use that information to identify areas of success and areas needing improvement. Only districts receiving Title III funds, however, need to notify parents of a failure to meet AMAOs or develop and implement Title III improvement plans if they fail to meet AMAOs in two consecutive years.

  8. Request for change to Immigrant grant allocation process • Review Immigrant Allocation Process document. • FYI, The number of immigrant students attributed to a district is based on the count of immigrant students reported on the October 1st, WDE684 data collection. • There may be a need for change in how districts “with limited or no experience in serving immigrant children and youth” is determined. • This year, no districts with 50 or more Immigrant students qualified for an immigrant grant and of the four districts that were initially identified for funding, only 17 (or 4.4%) out of the 383 immigrant students in the state were included.

  9. Request for change to Immigrant grant allocation process • Proposed changes: • Define the line for districts with little or no experience serving immigrant students at the average # of immigrant students in districts reporting immigrant students, instead of the arbitrary number of 50. • For example, this year there were 24 districts with immigrant students and 383 immigrant students total for an average of 15.96 (383 ÷24=15.96) immigrant students per district.

  10. Request for change to Immigrant grant allocation process • Exclude districts with fewer than five immigrant students from eligibility. • If we would have excluded districts with fewer than five immigrant students this year, only three districts that qualified for funding would have been excluded, accounting for only 4 immigrant students. • The way allocations calculations came out this year, 3 immigrant students qualified for half, or $10,000, of the $20,000 in immigrant grant funds.

  11. Title III – ELL Funding • This year we have had some significant changes in the districts that qualify for funding. • One district with a significant ELL population had previously not been eligible for Title III – ELL formula grant funding because it had received a Title III discretionary grant. • That grant expired last year, so this year the district became eligible for the Title III – ELL formula grant funding. • Wyoming still has 11 districts eligible for the Title III – ELL formula grant funding, but one is new and one that received funding last year didn’t this year.

  12. ELL with Disability Exemption from ACCESS for ELLs • Initially, from verbal guidance from the US Department of Education, we thought that it might be possible to exempt ELLs with Disabilities from some or all of the ACCESS for ELLs where appropriate and sufficiently documented in an IEP. • After initial discussions with the Special Programs Division, it was determined that this would be inappropriate because an IEP is intended to be a document that ensures inclusion in education and testing, not exclusion from testing.

  13. ELL with Disability Exemption from ACCESS for ELLs • Discussions have been started with the Standards and Assessment Division and the Special Programs Division to determine if there is an appropriate way to allow exemptions on some or all of the ACCESS for ELLs students with disabilities. We hope to have a state policy and procedure in place for next school year.
