    3. 3/5/2012 Proprietary and Confidential 3 DOT Regulation Awareness for Drivers Introduction U.S. Department of Transportation Federal Motor Carrier Safety Administration requires that all regulatory compliance with the Department of Transportation (DOT) is the responsibility of all commercial motor vehicle operations. Requirements The Federal Motor Safety Carrier Regulations (390.3)(e)(2) require every driver and employee shall instructed and shall comply with, all applicable regulation. All drivers are required to familiarize themselves with the Federal Motor Carrier Safety Regulations, (FMCSR). Objective After completing this training program, drivers will have a general understanding of the Federal Motor Carrier Safety Regulations Parts 382, 383, 390, 391 & 395. Drivers Responsibility:Maintain appropriate Drivers License, completing all required DOT Driver Qualification and renewal forms, completing and maintenance of DOT Physical, completing all required Drug and Alcohol testing, timely submission of Hours of Service records, submitting vehicle inspection records, submitting all roadside Inspections with in 24 hours and reporting all convictions,suspensions and revocations within 24 hours and Out of Service orders immediately. Drivers Responsibility:Maintain appropriate Drivers License, completing all required DOT Driver Qualification and renewal forms, completing and maintenance of DOT Physical, completing all required Drug and Alcohol testing, timely submission of Hours of Service records, submitting vehicle inspection records, submitting all roadside Inspections with in 24 hours and reporting all convictions,suspensions and revocations within 24 hours and Out of Service orders immediately.

    4. 3/5/2012 Proprietary and Confidential 4 DOT Regulation Awareness for Drivers Part 382- Controlled Substances and Alcohol Use and Testing. The purpose of this part is to establish programs designed to help prevent accidents and injuries resulting from the misuse of alcohol or the use of controlled substances by drivers of commercial motor vehicles. 382.201 Alcohol concentration No driver shall report for duty or remain on duty with an alcohol concentration of 0.04 382.205 On-duty use No driver shall use alcohol while performing safety-sensitive functions. 382.207 Pre-duty use No driver shall perform safety-sensitive functions within four hours after using alcohol. 382.209 Use following an accident No driver required to take a post-accident test shall use alcohol for eight hours following the accident, or until he/she undergoes a post accident test. 382.211 Refusal to submit to a required alcohol or controlled substances test No driver shall refuse to submit to an alcohol or controlled substance test. 382.213 Controlled substances use No driver shall report for duty or remain on duty when the driver uses any controlled substance.

    5. 3/5/2012 Proprietary and Confidential 5 DOT Regulation Awareness for Drivers Part 383- Commercial Drivers License Standards The purpose of this part is to reduce or prevent truck accidents, fatalities, and injuries by requiring drivers to have a single commercial motor vehicle drivers license and by disqualifying drivers who operate a commercial motor vehicle (CMV) in an unsafe manner. 383.1(b)(1) Purpose and scope Prohibits a commercial motor vehicle (CMV) driver from having more than one commercial drivers license (CDL). 383.1(b)(2) Purpose and scope Requires a CMV driver to notify his/her current employer and the drivers State of domicile of certain convictions.

    6. 3/5/2012 Proprietary and Confidential 6 DOT Regulation Awareness for Drivers Part 390- General This part establishes general applicability, definitions, general requirements and information pertaining to persons subject to this chapter. 390.3(e)(2) Knowledge of and compliance with the regulations Every driver and employee shall be instructed regarding, and shall comply with, all applicable regulations. 390.5(1) Definitions of Accident An occurrence involving a commercial motor vehicle operating on a highway in interstate or intrastate commerce which results in: A fatality; Bodily injury to a person who, as a result of the injury, immediately receives medical treatment away from the scene of the accident; or One or more motor vehicles incurring disabling damage as a result of the accident, requiring the motor vehicles to be transported away form the scene by a tow truck or other motor vehicle. 390.13 Aiding or abetting violations No person shall aid, abet, encourage, or require a motor carrier or its employees to violate the rules of this chapter.

    7. 3/5/2012 Proprietary and Confidential 7 DOT Regulation Awareness for Drivers Part 391- Qualifications of Drivers This part establishes rules for minimum qualifications for persons who drive commercial motor vehicles. 391.11 General qualifications of drivers 391.11(b)(1) Must be at least 21 years old. 391.11(b)(2) Can read and speak the English language sufficiently. 391.11(b)(3) By reason of experience, training, or both, safely operate the type of commercial motor vehicle he/she drives. 391.11(b)(4) Is physically qualified to drive. 391.11(b)(5) Has a currently valid CDL issued only by one state jurisdiction. 391.11(b)(6) Has prepared and furnished the motor carrier that employs him/her with a list of violations. 391.11(b)(7) Is not disqualified to drive a commercial motor vehicle. 391.11(b)(8) Has successfully completed a drivers road test.

    8. 3/5/2012 Proprietary and Confidential 8 DOT Regulation Awareness for Drivers Part 391- Qualifications of Drivers (Cont) This part establishes rules for minimum qualifications for persons who drive commercial motor vehicles. 391.13 Responsibilities of drivers 391.13(a) Can, by reason of experience, training, or both, determine whether the cargo he/she transports has been properly located, distributed and secured. 391.15 Disqualification of drivers 391.15(a) General. A driver who is disqualified shall not drive a commercial motor vehicle. A motor carrier shall not require or permit a driver who is disqualified to drive a commercial motor vehicle. 391.31 Road test A person shall not drive a commercial motor vehicle unless he/she has first successfully completed a road test and has been issued a certificate of drivers road test.

    9. 3/5/2012 Proprietary and Confidential 9 DOT Regulation Awareness for Drivers Part 392- Driving of Commercial Motor Vehicles 392.1 General Every motor carrier, its officers, agents, representatives, and employees responsible for management, maintenance, operation, or driving of commercial motor vehicles, or hiring supervising, training, assigning, dispatching of drivers, shall be instructed in and comply with the rules of this part. 392.3 Ill or Fatigued operator No driver shall operate a commercial motor vehicle and no carrier shall require or permit a driver to operate a commercial motor vehicle, while the drivers ability or alertness is impaired, through fatigue or illness. 392.4 Drugs and other substances No driver shall be on duty and possess, be under the influence of, or use, any drugs or other substances. 392.5 Alcohol prohibition 392.5(a)(1) No driver shall - Use alcohol, as defined in 382.107 of this sub-chapter; or be under the influence of alcohol, with in 4 hours before on duty or operating or having physical control of a commercial motor vehicle.

    10. 3/5/2012 Proprietary and Confidential 10 DOT Regulation Awareness for Drivers Part 392- Driving of Commercial Motor Vehicles 392.7 Equipment, inspection and use No commercial motor vehicle shall be driven unless the driver has satisfied himself/herself that the following parts and accessories are in working order, nor shall any driver fail to use or make use of such parts and accessories when and as needed. 392.8 Emergency equipment, inspection No driver shall operate a CMV until he/she is satisfied that the emergency equipment is in place and working properly. 392.10 Railroad crossing; slowing down required. A driver of a CMV that meets the following requirements must stop at all railroad crossings: Every bus transporting passengers Every CMV transporting any quantity of a division 2.3 chlorine. Every CMV that is required to be placarded. Every cargo tank CMV loaded or unloaded.

    11. 3/5/2012 Proprietary and Confidential 11 DOT Regulation Awareness for Drivers Part 392- Driving of Commercial Motor Vehicles (Cont) 392.11 Railroad grade crossing; Slowing down required. Every CMV other then those listed in 392.10 shall, upon approaching a railroad grade crossing, be driven at a rate of speed which will permit said CVM to be stopped before reaching the nearest rail of such crossing and shall not be driven upon or over such crossing until due caution has been taken to ascertain that the course is clear. 392.22(a) Hazard warning signal flashers Whenever a CMV is stopped on upon the traveled portion of a highway for any cause or the shoulder of a highway for any cause other then necessary traffic stops, the driver shall immediately active the vehicular hazard warning signal flashers. 392.22(b) Placement of warning devices 392.22(b)(1) Whenever a CMV is stopped upon a traveled portion or the shoulder of a highway for any cause other then necessary traffic stops, the driver shall, as soon as possible (within 10 minutes) set up the required warning devices. The driver must complete this task within 10 minutes. The warning devices must be placed in the following manner. One on the traffic side 10 feet back (4 paces) from the unit in the direction of approaching traffic. One 100 feet back (40 paces) in the direction of approaching traffic. One 100 feet back (40 paces) in the center of the lane or shoulder that the CMV is in. Hills and curves, if stopped within 500 feet of curve or obstructions to view, the devices must be placed 100 to 500 feet from the stopped CMV.

    12. 3/5/2012 Proprietary and Confidential 12 DOT Regulation Awareness for Drivers Part 395- Hours of Service of Drivers 395.1(a) General The purpose of this part is to reduce or prevent truck accidents, fatalities and injuries by requiring drivers and carriers to comply with the hours of service. The rules in this part apply to all motor carriers and all drivers. 395.2 Definitions Adverse Driving conditions means snow, sleet, fog, other adverse conditions or unusual road and traffic conditions unknown at time of dispatch. Driver-salesperson means any employee who is in engaged both in selling goods, services, or the use of goods, and in delivering by CMV. Driving time means all time spent driving a CMV. Eight consecutive days means the period of 8 consecutive days beginning on any day at the time designated by the motor carrier for a 24-hour period. Multiple stops means all stops made in any one village, town, or city may be computed as one. On duty time means all time operating under the direction of the carrier / employer. Sleeper berth means a birth conforming to the requirements of the Federal Motor Carrier Safety Regulations. Twenty-four-hour period means any 24-consecutive hours beginning at the time designated by the motor carrier for the terminal from witch the driver is normally dispatched.

    13. 3/5/2012 Proprietary and Confidential 13 DOT Regulation Awareness for Drivers Part 395- Hours of Service of Drivers (Cont) 395.3 Maximum driving time for property-carrying vehicles 395.3(a)(1)&(2)No driver will drive a CMV more then 11 cumulative hours following 10 consecutive hours off duty; or for any period after the end of the 14th hour on duty following 10 consecutive off duty. 395.3(b)(1)(2)No driver shall drive a CMV having been on duty 60 hours in any 7 consecutive days if the carrier does dot operate everyday of the week; or have been on duty 70 hours in any 8 consecutive days if the carrier operates CMV every day of the week. 395.3(c)(1)&(2)Any period of 7 or 8 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours.
