  3. QUESTION 1 I cannot marry my partner because we are the same sex, am I entitled to paternity leave when she adopts our baby? Yes anyone who is the spouse or partner of someone who becomes an adoptive parent is entitled to Adoption support leave No you must be the adoptive parent yourself. Yes but only if you have been confirmed as partners in a civil ceremony. No you must take unpaid leave or annual leave.

  4. QUESTION 2 I am due to start my maternity leave in 6 weeks I would like to return on a part-time basis should I apply now to start back on the day I return? The best time to start part-time working is when or after you return to work from Maternity leave Yes if you apply now there is more chance of you being accepted to work Part time as you are not at work so are surplus staff. You can go part time whilst on Maternity leave you do not lose any money and are thus guaranteed part time working on return No wait until you have got back to work.

No it is only applicable to officers below the rank of Chief Inspector Any Police Officer can submit an application to work part time Provisions for Part time working apply to anyone below the rank of Superintendent No the rules about part time working apply to female officers only

  6. QUESTION 4 As a part-time worker when I am required to work one of my free days, what I am entitled to claim? Nothing you will just get your day back at some point The same rules apply as for rest day working You get extra pay and your free day back It all depends on the job you are asked to do on the day you are required to work i.e. is it one anyone can do or just you.

  7. QUESTION 5 I have just started working part-time and the Force has subject all of my allowances pro rata, can they do this? No not at all Certain allowances are subject to pro rata reduction but not all. Yes, the Force must reduce all your allowances pro rata I lose all my allowances when I go part time but they return when If I go back full time

  8. QUESTION 6 I work part time on Friday and Saturday nights. I should finish at 2am but the clubs all turn out then, thus together with the full time officers I am kept on for an extra hour for which they get paid an enhanced rate but I don’t is that right? Yes you cannot claim overtime until you have worked the same hours as a full time officer You cannot be asked to work overtime whilst on part time working it defeats the object. If the claim was for pay then the full time officers could claim half hour at overtime rate, you can claim 1hr at flat rate No you are allowed to claim for any overtime at overtime rates.

One week paid and dependant on your length of service a second week equivalent to Statutory Maternity Pay (£123.06) Two weeks paid leave None One week paid leave only

Yes they can ask you to make up the hours Regulations take care of this and you can take reasonable time off to cater for an emergency Yes you cannot just take time off, you will have annual leave taken from your card or take time due No, I is only reasonable they should let you go it’s the decent thing

  11. QUESTION 9 I work part-time when a bank holiday falls on my rest day I am entitled to the same 8hrs paid leave as full time officers? Yes everyone is entitled to Bank Holidays off work, it is the law It doesn’t matter I am not allowed to work Bank Holidays as a part time officer No your leave entitlement depends on the amount of hours you work per week If I normally work 12 hr shifts then I am entitled to 12hrs off on a Bank Holiday

  12. QUESTION 10 My job share partner is leaving can I just extend my hours or do I have to go through the Force selection process to get the job? You can stay in the role but cannot apply for the extra hours You can apply to extend your hours but you will have to go through the selection procedure Your only choice is to go back to work full time to cover the whole post. The Force must try to find a replacement to take over the other role if they do not after 3months you can then extend your hours

An officer who is not the adoptive parent, but whose spouse or partner becomes an adoptive parent is entitled to adoption support leave at or around the time of adoption All officers are entitled to 2 weeks adoption support leave, the first week of which will be on full pay. Officers who are working part time and job sharing are also eligible on a pro rata basis. Those officers who have 26 weeks continuous service at the notification week, will be entitled to be paid for the second week at Statutory Paternity Pay rate (SPP is paid at the same rate as SMP from April 2009 £123.06 per week). The notification week is the week in which they are notified of being matched with a child for adoption Adoption support leave is pension able, reckonable for incremental pay and leave purposes and for inclusion in any period of probationary service Next answer Continue Q 2

I would like to return on a part ime basis should I apply nowto start working on the day I return Police Officers can request an alteration to there working hours at any time but woman returning from maternity leave may find it particularly helpful. You can apply for part time working whilst on maternity leave however there are pitfalls. If your request is successful it is best to move to part time when or after you return to work and not before or during your maternity leave because your circumstances may change whilst you are on maternity leave, for example if you have agreed a date to start part time working on the day you return to work but you cannot return as you are off sick, you will never the less be paid at the reduced rate. Question 4 • As a part time worker, when I am asked to work one of my free days what am I entitled to claim? • When an Officer working part time is required to work a free day it attracts the following compensation • 1. If the duty is one only that Officer can perform (e.g. attendance at court) and;- • the officer receives more than 15 days notice the free day should be reallocated within 4 days of it being cancelled; • the officer receives less than 15 days notice then the additional hours should be paid at plain time or alternatively taken as time of equal to the duty time worked. • 2. If the duty is one that can be performed by any officer (e.g. operational policing) and;- • the officer receives more than 15 days notice the free day should be reallocated within four working days of it being cancelled • the officer receives less than 15 days notice they should be paid at the appropriate rate of pay for Rest Day working Next answer Continue Q 5

  18. Question 5 I have just started working part-time and the Force has subject all of my allowances pro rata, can they do this? A part-time officer should receive pro rata payment of an allowance only if the expense for which allowance is paid reduces with the reduction to part-time hours so housing allowance would be affected but allowances such as car user allowance would not be. A partner/spouse of a part-time officer also a serving Police Officer in receipt of housing allowance and living with the part-time officer is entitled to an increase in their housing/rent allowance to compensate Next answer Continue Q 6

  19. Question 6 Unless a doctor certifies that you are not fit enough to attend you must attend. If you are required to attend when on Police paid maternity leave, your Police paid maternity leave will be extended by the period that you were required to attend, but this will not extend your 26 weeks SMP period. However, if you are in receipt of SMP you will lose the SMP for the whole of any week and your statutory maternity leave period will not be extended. You will be paid for any days you are required to attend court and of course a risk assessment has to be completed and ant special measures incorporated. You will not be expected to attend court in Uniform. I work part time on Friday and Saturday nights. In these circumstances the full time officers will only be able to claim for 30mins of the one hour worked as they must give up the first half hour if they had not been informed before the start of the tour of duty they would be working extra. This would be at enhanced rate, however as a part-time officer you can claim for the full hour at plain time as it is not classed as overtime until the full 40hrs per week is worked. Any hours worked in addition to the agreed hours of duty are now pensionable. Next answer Continue Q 7

An officer who is the child’s father or the partner or the nominated carer of an expectant mother is entitled to maternity support leave, at or around the time of the birth. A nominated carer is the person nominated by the mother to assist in the care of the child and to provide support to the mother at or around the time of the birth. All officers are entitled to 2 weeks maternity support leave, the first week (40hrs) is paid. Those officers who have 26 weeks continuous service at the 14th week before the expected week of confinement will be entitled to be paid for the second week (40hrs) at Statutory Paternity pay (equivalent to SMP - £123.06 per week) Officers who are at work part time or job share are also eligible to be paid for each paid leave day on a pro rata basis. All leave taken as maternity support leave is pensionable, reckonable for incremental pay and leave purposes and for inclusion in any period of probationary service Next answer Continue Q 8

Question 8 • My child was hurt at school I was contacted and had to take him to the hospital, I left three hours early and the Force want me to make up the hours is that right? • Regulation 33 sates that all officers, regardless of length of service, are entitled to take a reasonable amount of time off during their normal duty periods in order to take action which is necessary • to deal with the death of a dependant • to deal with an unexpected disruption or breakdown in the care of a dependant. • to deal with an incident involving the officers child during school hours. This list is not exhaustive and each situation should be considered individually taking into account the balance between the needs of the Force and the individuals immediate needs Officers should not be victimised for taking dependant’s leave. Forces should offer short periods of time off for people with caring responsibilities to enable them to cope with short term difficulties as paid leave.   22. Question 9 • I work part-time when a bank holiday falls on my rest day I am entitled to the same 8hrs paid leave as full time officers? Whilst a full time officer is entitled to 8hrs paid leave on each of the public holidays, part time officers are entitled to public holiday leave on a pro-rata basis according to the number of hours they perform duty, for example;- • If a part time officer works 20hrs per week they are entitled to 50% of the hours of public holiday leave received by a full time officer, equivalent to 4hrs paid leave for each public holiday • If a part time officer works 32hrs per week they are entitled to 80% of the hours of public holiday leave received by a full time officer, equivalent to 6.4hrs paid leave for each public holiday • Officers who work in excess of 8 hours are not entitled to more than 8 hours Next answer Continue Q 10

  23. Answer 10 My job share partner is leaving can I just extend my hours or do I have to go through the Force selection process to get the job? A part time officer who was appointed as a full time officer can revert to full time working within 3 months of application. This is not necessarily to the same role, but in the case of a job share officer it could be regarded as advantageous for both the officer and the Force. Ifone of the two job-sharing officers reverts to full-time service or ceases to be a police officer the remaining job-sharer retains the rank in which he/she was appointed and shall remain as a part-time officer in that or another post with the same determined hours and work pattern (unless the remaining job-sharer otherwise agrees). The Force shall take all reasonable steps to find a new or alternative job-share partner within three months. In the event that no such new or alternative job-share partner is found within the period the remaining job-sharer will continue to perform duty in a part-time appointment in a post to be agreed between the officer and the chief officer, or be permitted to revert to full-time service, END SHOW
