Bullying: Process • STUDENT CODE OF CONDUCT: If a student believes that he or she has experienced bullying or has witnessed bullying of another student, it is important for the student or parent to notify a teacher, school counselor, principal, or another district employee as soon as possible to obtain assistance and intervention. The administration will investigate any allegations of bullying or other related misconduct. The district will also provide notice to the parent of the alleged victim and the parent of the student alleged to have engaged in bullying. A student may anonymously report an alleged incident of bullying at www.sisd.netunder the Stop Bullying tab at https://www.anonymousalerts.com/socorroisd/default.aspx. If the results of an investigation indicate that bullying has occurred, the administration will take appropriate disciplinary action and may notify law enforcement in certain circumstances. Disciplinary or other action may be taken even if the conduct did not rise to the level of bullying. Available counseling options will be provided to these individuals, as well as to any students who have been identified as witnesses to the bullying. Any retaliation against a student who reports an incident of bullying is prohibited.

  9. Steps to Take – When a Bullying Complaint is Received Investigation Report: (SISD FORM) Document the report. Even if the complainant and his/her parents do not want to put the complaint in writing, the appropriate administrator must do so. • Take immediate steps to investigate. Document the investigation and inform parents. • Notify the parent of the alleged victim before the third business day. • Notify a parent of the student alleged to have engaged in the conduct within a reasonable amount of time after the incident is reported.

  10. Taking the Report • Keep a record – Date, Time, Details of Conversation • Allow the victim to tell the story • Get the Facts – Who? Where? When? How often? Verbal or Written? History? Witnesses? • Determine the damage – Physical? Emotional? How does this impact the school day/environment? • Get a statement if necessary • What is desired outcome? What resolution is the victim seeking? • Notify/Involve the appropriate AP for investigation and Counselor for social/emotional support • Take interim action to protect the targeted student. • Take prompt and effective action to end the bullying/harassment, eliminate any lingering effects, and preventing future infractions. • Prevent retaliation against the victim and person making the report. • Modify IEPs, BIPs, 504 Plans, etc. as appropriate. • Contact the Parent • Keep a professional record of every conversation

  12. Tips for Performing an Investigation • Take claims and allegations seriously – no matter how trivial they may seem. • Interview the parties and all possible witnesses, and be professional. The investigator must demonstrate in his or her behavior that the complaint is being taken seriously. • Maintain proper documentation of the investigation, such as taking detailed interview notes or securing relevant evidence. • Use discretion when talking to people in the course of the investigation. • Treat all persons with dignity and respect. • Know when to get help. Remain neutral. Consider using an outside investigator or other administrator to conduct the investigation if questions about the designated investigator’s impartiality arise. • Take immediate and appropriate action upon conclusion of the investigation.

Following Up – Moving Forward • Offer counseling to ALL students who may have participated • Do an investigation for ANY claim not previously investigated • “Stay Away” agreements and schedule changes • Active monitoring, Taking Steps • Staff notifications - Counselors, Teachers, other Administrators • Checking in with the victims - Document • ARD or 504 Committee?

Bullying (FFI) vs. Harassment (FFH) • Harassmentincludes: • Conduct that meets the definition established in district policies DIA(LOCAL) and FFH(LOCAL); • Conduct that threatens to cause harm or bodily injury to another person, including a district student, employee, board member, or volunteer; is sexually intimidating; causes physical damage to the property of another student; subjects another student to physical confinement or restraint; or maliciously and substantially harms another student’s physical or emotional health or safety, as defined in Section 37.001(b)(2) of the Education Code; or • Conduct that is punishable as a crime under Penal Code 42.07, including the following types of conduct if carried out with the intent to harass, annoy, alarm, abuse, torment, or embarrass another: • Initiating communication and, in the course of the communication, making a comment, request, suggestion, or proposal that is obscene, as defined by law; • Threatening, in a manner reasonably likely to alarm the person receiving the threat, to inflict bodily injury on the person or to commit a felony against the person, a member of the person’s family or household, or the person’s property; • Conveying, in a manner reasonably likely to alarm the person receiving the report, a false report, which is known by the conveyor to be false, that another person has suffered death or serious bodily injury; and • Sending repeated electronic communications in a manner reasonably likely to harass, annoy, alarm, abuse, torment, embarrass, or offend another.

David’s Law: The Specifics • Alters the definition of bullying to include cyberbullying. • Parents must be notified three business days after the date any bullying incident is reported. • Clarifies that off-campus speech via cyber bullying can be disciplined and is within the District’s purview. • Allows a report of conduct to law enforcement for any action as described by 22.01 (assault) or 42.07(a)(7) (harassment) of the Penal Code. Creates immunity for any such report. • Allows for a parent or student to seek injunctive relief from any bully or their parent to cease any and all cyberbullying. • Counselors • Must serve as an impartial, nonreporting resource for conflicts involving two or more students, including accusations of bullying. • Can rise to the level of a crime! • 42.07 of the penal code
