Reason for the change After the storms the last couple of years the Town Commission realized that the current flood code could have adverse impacts on the home owners and asked that the Town Code be reviewed for possible changes. Also F.E.M.A. create a model flood code, which addressed many of the concerns of the Town Commission.

Background on flood code ordinance 1971 the National Flood Insurance Program started, know as the “N.F.I.P.” Elevations were established for 100 year storm events and F.E.M.A. issued official flood insurance rate maps, know as “F.I.R.M.”, which delineate areas of special flood hazard Longboat Key is in a flood hazard area

Terms that are commonly used in talking about flood regulations N.F.I.P.-National Flood Insurance Program F.E.M.A.-Federal Emergency Management Agency C.R.S.-Community Rating System F.I.R.M.-Flood Insurance Rate Map B.F.E.-Base Flood Elevation Freeboard- Additional height above the required minimum elevation of the F.I.R.M. C.C.C.L.-Coastal Construction Control Line F.D.E.P.- Florida Department of Environmental Protection

    6. Five year cumulative rule The five year cumulative rule has been Eliminated

    7. Enclosed area below base flood elevation: A-zones landward of the C.C.C.L. The interior portion of such areas shall not be finished into habitable/living space, but may be conditioned so long as the equipment required to condition the space is not located below base flood elevation or required free board and may be partition into separate rooms Code section 154.15(B)(3)(c)

    8. Enclosed area below base flood elevation: V-zones and A-zones seaward of the C.C.C.L. The interior portion of such areas shall not be finished or partitioned into habitable / living space. May be conditioned so long as the equipment to condition the space is elevated above the local flood regulations for freeboard and the area is partitioned off with breakaway walls that will not exceed 20lbs per sq. ft. Other areas that may be conditioned without breakaway walls are limited to stairwells, foyers, and elevators for access. Code section 154.18 (A)(6)(c)

    9. Freeboard Freeboard - The space between the required B.F.E. per the FIRM flood maps and the Town Ordinance . (this is based on the FEMA recommended flood model for freeboard) * A-zone - New residential elevated one foot above B.F.E. , New Non-residential- flood proofed one foot above B.F.E. * V-zone-three feet above B.F.E.or elevation required by F.D.E.P. whichever is higher * C.C.C.L.- all zones on the seaward side will be required to be three feet above B.F.E. or elevation required by F.D.E.P. whichever is higher

    10. 50% rule and when it applies 50% rule applies to all structures that are FEMA non-conforming, and any structure seaward of the CCCL that does not meet the town flood code, this includes structures that do not meet the three foot freeboard , DOES not include structures built in A-zones landward of the CCCL from 1974 to Dec 31, 2006 establish by this code on its effective date of Jan 1, 2007

    11. Cost of damage / improvements method The value of damage/improvements shall be by a sworn statement under oath by the owner, contractor or both, with the applicable contract for the work. This will be in the form of written affidavit from both.
