Implementation of the Workplace Based Learning Programmes Regulations Communique to the Sector: Done in March 2019 – linked to CHIETA projects; 2nd communique to be done by the middle of May 2019 where FAQs will be answered; 3rd communique re-phasing out of historical qualifications and consultations with stakeholders will happen before the end of Dec 2019. Engagement with DHET: On April 12th DHET has requested all SETAs to prepare a policy and procedure, this will take approximately 2-3 months to finalise. SETAs possibly delivering a joint policy; Workplace approval is only required for learnerships & apprenticeships

Engagement with DHET (Cont.): Learnerships not registered by the DG of DHET are not valid, which therefore makes a SETA non-compliant. Leaners cannot be registered nor funded. LAs submitted prior April 2019 vs Training Implementation. DHET Response-All LAs submitted prior 1 April 2019 will be considered in line with LR 2007

Supporting Evidence: Still applies as in the past: ID document (certified within the last 3 months); Employment contract/record of service; Highest qualification; Implementation plan; Medical, etc. MIS Readiness Workplace Approval Nos. will be back-end linked to learner enrolments; The workplace approval no. must be provided for the enrolment process for learnerships and apprenticeships on the agreement;

Criteria for Enrolment: Parties to the agreement may initial each page, consistency must apply; All fields to be completed; SETA must receive the agreement within 30 days of learner signing; CONDITIONAL PLACEMENT: Employer must conditionally place the learner on the programme pending the SETAs registration and compliance process; “If a SETA receives an LA that is not compliant, they will not process it until the gaps identified are closed. If the stakeholder is not accredited for the intervention the SETA will not enroll that learner.” If SETA is unable to enrol the learner the conditional placement must be terminated;

Criteria for Enrolment (Cont.): Learner enrolment to take place at the SETA where employer falls within; SETA to enrol/register learner within 30 days of receiving the agreement (Remember: employer to submit agreement within 30 days of learner signing); Electronic signed Agreements- Are they acceptable?: DHET Response-They will be accepted. RECORDS required Reg 21(2) i.t.o. hard vs soft copies clarification?: DHET Response-This will be verified through DHET principals and guidance will be provided. This is not condoning the electronic processes, but the regulation, as the standing principle, currently requires hard copies for auditing purposes.

Suspension of Agreement: Based on employer or learner request the SETA may suspend a registered agreement, all parties must agree; Written application must be submitted to CHIETA Citing reason/s; Consent from all other parties; CHIETA: extends the completion date by the period of the suspension, suspend any grant associated. Termination of Agreement Employer or learner makes a written request; Learner has terminated the contract of employment; SDP has requested on good cause to terminate and other parties agree; SETA or employer unable to arrange another provider; NOTE: CHIETA WILL PREPARE THE SUSPENSION AND TERMINATION ANNEXURE, PLACED ON WEBSITE

General Must ensure that the employment contract covers the period for assessment (including trade tests) as there is no room for extension in these regulations; Do not insert start and end dates : CHIETA will do this as the start date is the date of registration/enrolment; A list of all CHIETA qualifications, learnerships will be placed on the website under the ETQA section; A list of all other SETA registered learnerships will also be made available; The list of all CHIETA SIC codes:

QCTO processes for the approval of accreditation CURRENT CHALLENGES: • Incorrect Letters of Intent (LOI) sent to QCTO by SDPs. • NOTE: To be submitted six (6) months before the actual accreditation period expires. • Unclear Referral Letters received from QCTO for CHIETA to accredit SDPs. • Delays on Skills Development Providers (SDP) receiving accreditation letters from the QCTO.
