Background… • Jessica Lunsford Act passed by the 2005 Florida Legislature • Increases measures used to monitor sexual offenders or predators • Contains specifications related to individuals with access to school district campuses while students are present • The statute, as amended, applies to three categories of non-instructional & contractual personnel, all of whom must meet Level 2 Background Screening requirements, including those: • Who are permitted access on school grounds when students are present, • Who have direct contact with students, or • Who have access to or control of school funds. • School districts must conduct the fingerprinting/background screening of non-instructional/contractual personnel and determine whether the individual has been convicted of a crime of moral turpitude.

Level 2 background screening definition… • Fingerprinting the individual & submitting the prints to the Florida Department of Law Enforcement (FDLE) to compare against • Statewide criminal & juvenile records maintained by FDLE • Federal criminal records maintained through the FBI • It may also include a local criminal records check through local law enforcement agencies

Maintenance of screening results… • After receiving the initial background check results from the FDLE, the original submitting district • Will thereafter be electronically notified by FDLE, in writing, of any new arrests • Should forward the arrest information to any districts with which they have shared the criminal record • Results in a labor intensive records maintenance process

Act implementation challenges… • No statewide registry of vendor prints currently exists • Impact: Vendors are required to be repetitively printed in multiple schools/districts • No digital systems exist for easy sharing of data between (1) schools within a District or (2) Districts across the State • Impact: Vendors are required to be repetitively printed in multiple districts • After receiving the initial background check results from the FDLE, the original submitting district • Will thereafter be electronically notified by FDLE, in writing, of any new arrests • Should forward the arrest information to any districts with which they have shared the criminal record • Impact: No digital system exists for records maintenance & distribution of updated information • No specific funds were allocated to pay for the cost of the Act • Impact: School Boards are faced with unbudgeted, legislated requirements

State-wide biometric enrollment concept… Use commercially available biometrics readers/database servers & Internet communications for rapid implementation • At the school level • Obtain the digital fingerprint of each person required by the Act to be registered for access to the school • Electronically share the fingerprint image and the person’s information with the District Office for consolidation • At the District level • Consolidate Level 2 background screen requests & submit to FDLE • Share FDLE screening results with all schools across the district where the person requires and is granted access • Maintain a centralized District database for posting on-going updates from FDLE of infractions by enrollees • At the FDLE level • Perform Level 2 background screens and publish results to the submitting District • Maintain a constantly updated, state-wide database of registered persons cleared for access to school properties, pursuant to the requirements of the Act (if desired)
