Avoidance and Minimization Scrub Habitat Avoidance • Project Development & Environment Study Results • Concurrence from USFWS that the project is not expected to adversely affect Florida Scrub-jay; letter dated 7-20-06. • Commitment to support Brevard County EEL initiative to protect scrub habitat. • Accomplished by • Intentionally avoiding scrub areas for potential locations of new ponds.

Avoidance and Minimization Minimization • Project Development & Environment Study Results • Initially evaluated 7 ponds sites within the St. Sebastian’s River Preserve State Park (SSRPSP) and Micco Scrub Sanctuary • Study recommendations – 3 ponds • Design • Ponds within the SSRPSP reduced to 2 and 0 in Micco Scrub Sanctuary • Accomplished by • Compensating treatment, • Utilizing the existing borrow pit • Additional and larger pipe to convey water

Avoidance and Minimization Minimization • Each potential pond site evaluated for impact on: • wetlands • floodplain • protected species • cultural resources • viable use for a retention pond • Each pond site • minimized impacts on these characteristics • designed to meet the SJRWMD/FDEPpond requirements

  8. Land Value Compensation • Fair Market Value = 1.5 times appraised value • Fair Market Value as agreed to by all parties: • Parcels 800 A and B SJRWMD: $310,050 • Parcel 800 C: Brevard County:$33,000 • Parcel 800 D: FFWCC:$84,900

  10. Approved Mitigation Plan • Acquisition and enhancement of 25.78 acres at the Sembler Property • 12.38 acres of stream restoration at Wheeler Groves • Total Cost = $2.1 million SSRPSP

Enhancements Beyond Mitigation • Protection of the Wood StorkMaintaining existing vegetation and planting tall trees along the ponds adjacent to the interstate. • Removal of Exotic/Invasive Species • FDOT is working with SSRPSP Personnel to eradicate the exotic/invasive species within the right of way.

  12. Pond Inspection/Maintenance Program • FDOT will • Inspect all ponds every 2 years/mow regularly • Remove invasive species as needed • Condition of easement agreement with the Board

  14. Pond A Pond A is 4.2 acres • Owned by Board of Trustees (50%) and SJRWMD (50%) • Managed by Division of Recreation and Parks • Site consists of upland pine flatwoods, hydric pine flatwoods • New wet detention pond • No Scrub-jay habitat C-54 CANAL

  15. Pond B Pond B is 10.3 acres • Owned by Board of Trustees (50%) and SJRWMD (50%) • Managed by Division of Recreation and Parks • Surrounded by dry pine flatwoods with some scrub oaks • Existing Borrow Pit • Marginal Scrub-jay habitat on adjacent lands • Verified no Scrub-jays

  16. Pond C Pond C is 2.6 acres • 1.4 acres owned by Board of Trustees • Managed by Brevard County - Environmental Endangered Lands • Site consists of wet and dry pine flatwoods • New wet detention pond • No Scrub-jay habitat

  17. Pond D Pond D is 3.5 acres • 2.5 acres owned by Board of Trustees • Managed by FFWCC • Site consists of wet and dry pine flatwoods, and wet prairie • New wet detention pond • No Scrub-jay habitat Rest Area
