Abortion and “The Law” Roe Vs Wade – January 22, 1973 The alias "Jane Roe" was used for Norma McCorvey, on whose behalf the suit was originally filed, alleging that the abortion law in Texas violated her constitutional rights and the rights of other women.. The defendant was the district attorney of Dallas County, Texas, Henry B. Wade.

Abortion and “The Law” Roe Vs Wade – January 22, 1973 The Court's decision in this case was that the Ninth Amendment, in stating that "the enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people," protected a person's right to privacy.

Abortion and “The Law” • The Supreme Court ruled that a woman, in consultation with her physician—and free from government interference--has a constitutionally protected right to have an abortion in the early stages of pregnancy; that is, before viability. • In 1992, in Planned Parenthood v. Casey, the Court reaffirmed the right to abortion. However, by giving states the right to enact restrictions that do not create “undue burdens” on women seeking abortions, the ruling significantly weakened the legal protections previously afforded women and their physicians.

Abortion and “The Law” • Currently, 35 states enforce parental-consent or notification laws for minors seeking abortions. • Congress has barred the use of federal Medicaid funds to pay for abortions, except when the woman’s life would be endangered by a full-term pregnancy, or in cases of rape or incest. • Seventeen states use public funds to pay for abortions for some poor women, but only four do so voluntarily. The rest do so under court order.[20] About 13% of all abortions in the United States are paid for with public funds[21] (virtually all from state governments).[22]

Abortion and “The Law” 20 states have laws that could be used to restrict the legal status of abortion. 4 states have laws that automatically ban abortion if Roe were to be overturned. 13 states retain their unenforced, pre-Roe abortion bans. 7 states have laws that express their intent to restrict the right to legal abortion to the maximum extent permitted by the U.S. Supreme Court in the absence of Roe.

  38. Alternative “The Evan B. Donaldson Adoption Institute tells us that the number of infants available for private adoption in the United States has been decreasing. The factors which have contributed to this change are, "increased access to contraception,” "changed social attitudes about unmarried parenting,” and the big one, "the legalization of abortion."

  39. Alternative “Between 1989 and 1995, 1.7 percent of children born to never-married white women were placed for adoption, compared to 19.3 percent before 1973." In 1970 there were 89,200 new adoptive parents. In 1975, the last year for which such data is available, that number was cut almost in half to 47,700. The reason for the decline was due to the fact that "fewer U.S.-born white infants were available for adoption."

  40. Alternative “Only 2-3% of the more than 1 million teenagers who become pregnant this year will place their children up for adoption – I was born May 2, 1954– to parents who were young (my mom was 17) and having difficulty just making ends meet. An “unplanned pregnancy?” What if abortion had been legal then?
