D1 Helpsheet • Using the materials on Moodle, your evaluation of murder, voluntary manslaughter and involuntary manslaughter should: • include independent research of the criticisms of the current law • discuss and fully justify these criticisms • provide recommendations as to how the laws could be improved. • Consider the following questions: • Murder: • Should MR of murder include intention to cause GBH as well as killing? • Is a mandatory life sentence appropriate? • Voluntary manslaughter: • Consider how the updated law on provocation may have improved the use of this defence • Should the definition of “abnormality of the mind” be a legal test or a medical test? • Do “reasonable” people respond to provocation by killing? • Involuntary manslaughter: • Is it right that manslaughter is a very wide ranging offence? • Is it right that guilt is assessed objectively with no account of D’s personal circumstances? • Should MR of UAM include foresight of death? (at the moment it does not) • PLEASE NOTE: These questions are NOT an exhaustive list of what needs to be covered in this task but a suggestion as to how your work could be structured and what could be discussed
