  1. WTO Integrated Dispute Settlement System 1. Important component of multilateral trading system (MTS) to resolve trade disputes to ensure that trade flows smoothly.

  4. 4. Large degree of automaticity is involved • 5. Ensures Security and predictability of WTO multilateral trading system.

  5. 6. Although rule oriented system, still it favors mutually agreed solutions even when matter is pending before panels • 7. Intended to secure withdrawal of inconsistent measures thru quasi judicial national of procedures.

  6. 8. Solutions must be constituent with WTO Agreements and must not nullify and impair benefit alluring to members. • 9. Guarantees proper Balance between the rights and obligations of its members by giving assured access to DSS

  7. 10. Permits appeal mechanism on issues of law covered in panel reports. • 11. Ensures Compliance eith Recommendations • A) Thru-mutually acceptable solutions • B) Suspension of concessions • C) Compensations.

  8. 12. Over 400 Disputes referred to DSS during last 13 years. In large number of cases developed countries involved. • 13. Majority of cases involved agreements on agriculture, textiles, trips, sanitarium TBT trims etc.

  9. 14. Most developing countries unable to fully utilize DSS due to lack of representation knowledge expertise and high costsinuolved arm-twisting and power game still exist. • 15. India- had been involved in number of cases- lost Q.R. Patents, won shrimps textiles etc.
