Before we answer the question, 'Who pays the party wall surveyor fee costs?', let us explore a little more about the party wall, how modifications or additions to the wall need to be handled as per the law.  • A party wall is a wall that adjoining homeowners share. So, when one of the owners needs to get some work done on the party wall, they have to inform or serve a notice to the adjoining homeowners. When the adjoining homeowners receive the notice, they can respond in three ways:

  3. Consent to the work. In this case, a party wall surveyor is not involved, and therefore, no fees need to be paid to a surveyor. As soon as the notice period is over, the owner can start the desired work. • Dissent to work. It is the other extreme to option 1. In this case, because one or more owners have dissented, there is a dispute, and therefore, a party wall surveyor is appointed.  • In the third option, there is no response from the adjoining homeowner. It means that there is a deemed dissent. Again, a surveyor will be appointed in this option too. 

  4. Now, we come to the big question, 'Who pays the party wall surveyor fee costs?' In options nos 2 and 3, a surveyor needs to be appointed to assess the party wall. Since it is the building owner who instigates the party wall process, he is liable to pay the surveyor's fees. In case the building owner feels that the fees being charged by the surveyor are not fair, he can appeal to the Third Surveyor or the County Court with a specified period.

  5. Can the adjoining homeowners be liable for the fees ever? • Usually not. The law says that only the person 'desirous of carrying out the work' can be held responsible for paying the fees. However, in the following circumstances, the adjoining homeowner is also responsible for paying the fees:

If the party wall surveyor is instructed by the adjoining owners on matters over and above the Party Wall Act.  • When the adjoining homeowner refers to the Third Surveyor, the Third Surveyor decides to favor the building owner and against the adjoining owners. • If the adjoining owners request the building owner to commence work over and above his initial intentions, the adjoining owners need to bear the surveyor's fees.
