  2. Clear Mandate of the OPCW The OPCW has an obligation to provide assistance to any State Party which has requested such assistance if chemical weapons have been used against it, or if it feels threatened by the use of Chemical Weapons.

  3. (2) Mandate of OPCW • Primary function is limited to coordinating the offers of Assistance by States Parties and delivering them to the requesting State Party. • Provide emergency measures of assistance from within the resources placed at its disposal. • OPCW still developing its concept of Assistance and Protection.

  4. Global Terrorism • Requires a coordinated response • Chemical Terrorism is a looming threat • State of Preparedness imperative

  5. Provisions of the Convention Each state Party has the right to request and to receive Assistance and Protection v/s the use or the threat of Use of CWs if it considers that: (I) CWs have been used against it; (ii) RCAs have been used as a method of warfare; or (iii) It is threatened by actions or activities of any State that are prohibited for State Parties.

  6. Whatever the source of the Threat Except for the more general stipulation in subparagraph (iii), the right to request and receive assistance is not conditional upon the source of the threat or the party or individuals who may have used Chemical Weapons.

  10. Emergency Assistance • Dispatched in cases of use of CW • Immediate dispatch • Decision by the Director-General

  11. Humanitarian Assistance • Dispatched in cases of serious threats of Use of CWs • Decision by the Executive Council

  12. Supplementary Assistance • Dispatched after simple majority vote of the Executive Council • Decision within 48 hours of receipt of the investigation report

Protection Against CWs Obligations of States Parties: • to facilitate in the fullest possible exchange of equipment, material, scientific and technological information concerning means of Protection; • To provide annually to the Secretariat information on its national programmes related to protective measures • to put their SSSF and OFPP under verification system of the organisation

(2) Protection Against CWs Rights of States Parties • to participate in the fullest possible exchange of equipment, material,scientific and technological information concerning means of protection; • To access a databank containing freely available information on various means of protection; • to receive expert advice and assistance in identifying their programmes for the development and improvement of a protective capacity

  15. Declaration of National Programmes for Protective Purposes • Declaration for Transparency • Analysis of benefits and problem areas • Promotion of possible exchange of knowledge

  16. Obligation on States Parties • Contribution to the Voluntary Fund for Assistance • Conclusion of bilateral agreements with the Organisation on the procurement, upon demand, of Assistance (EIF+180 days) • Declaration of the kind of Assistance that might be provided in response to an appeal by the organisation (EIF+180 days)

  17. The Bilateral Channel • Bilateral Agreement between States Parties to request or provide assistance • Agreement with other States Parties for emergency procurement of Assistance

  23. Practical Measures • To help State Parties build their own national capacity. • Organisation of national courses for first responders of chemical weapons attacks. • Preparation of a data bank of information related to protection against chemical weapons.
