  2. Who is Lily Ledbetter?

  3. Plaintiff in a 2007 Supreme Court case, Ledbetter v. Goodyear Tire & Rubber Company, alleging pay discrimination

  4. Why is she associated with the LLFPA?

  5. She lost her case because she failed to bring the case within the 180/300 day statute of limitations after the discrimination occurred. This statute overturns that Supreme Court decision

  6. Does the statute change the statute of limitations?

  7. No. Plaintiffs must still bring their claims within 180/300 days of the discriminatory act

  8. Then how is the decision overturned?

  9. The statute re-defines what constitutes the discriminatory act. The Supreme Court ruled that the pay decision that results in discrimination triggers the statute of limitations. The statute states each paycheck triggers a new statute of limitations

  10. Does the LLFPA make any other changes to existing discrimination law?

  11. The law expands the field of potential plaintiffs by allowing any person “affected” by an act of discrimination to file claims. This may allow family members to bring claims involving an employee’s pay

  12. Lily Ledbetter’s case involved a claim of sex discrimination. Does LLFPA only apply to claims of sex discrimination?

  13. No. The statute also applies for any protected classification.
