CHARTERin regards to competitive meter ownershipas approved by TAC on March 6, 2003 The Competitive Metering Working Group (COMETWG) will develop and recommend the business policies and procedures to implement competitive metering services that will become available to commercial and industrial customers beginning on January 1, 2004, in the competitive retail electric market in Texas, as proposed under the Public Utility Commission of Texas (PUCT) Rule 25.311

Competitive Meter OwnershipDeliverables with RMS and TAC Approval • DRAFT Competitive Metering Ownership Timeline for managing activities related to successful implementation of PUCT Rule 25.311 • April 23, 2003 RMS meeting, RMS approved the draft Competitive Metering Ownership Timeline as presented by the COMET WG, subject to change as necessary • May 8, 2003 TAC meeting, TAC approved the draft Competitive Metering Ownership Timeline as presented by RMS, subject to change as necessary. Future changes recommended by COMET will first be approved by RMS and then by TAC. • Standardized Lists of Three-Phase and Single-Phase Meters for Competitive Meter Ownership • April 23, 2003 RMS meeting, RMS approved the initial Standardized Lists of Three-Phase and Single-Phase Meters as presented by the COMET WG, as a deliverable to the PUCT on April 25, 2003. The Standardized Lists are subject to adding more meters to the list prior to January 1, 2004. • May 8, 2003 TAC meeting, TAC approved the initial Standardized Lists of Three-Phase and Single-Phase Meters as recommended by the COMET WG as a deliverable to the PUCT on April 25, 2003 and approved by RMS on April 23, 2003. The Standardized Lists are subject to adding more meters to the lists prior to January 1, 2004. Note: The COMET WG is currently discussing details that may be added to clarify the Standardized Competitive Meter Ownership List.

Competitive Meter OwnershipBusiness Process Flows (work in progress) • Business process flows have been developed by COMET and are in “draft” status, pending final review and consensus by the working group. • Finalizing the business process flows will include the development of or verification that requirements needed to support the introduction of Competitive Meter Ownership are in place on January 1, 2004. • Identifying the information flows and data requirements between Market Participants • Completion of forms required to transfer data between Market Participants • Documenting the data transfer method between Market Participants • Documentation for any required manual processes

Competitive Meter OwnershipTransaction Impacts Identified (work in progress) • Business requirements have been developed and delivered to TX SET for identified transaction changes necessary to implement Rule 25.311. • TX SET change control # 2003-512 • Provide a mechanism where the TDSP will apply a re-occurring credit on the 810_02 invoice to the CR for meter ownership. • TX SET change control # 2003-513 • Provide a mechanism where the TDSP can identify what type of entity owns the meter on the 814_20. • GAP • The conveyance of meter ownership information to “new” CRs as the result of an enrollment or drop has not been included as an automated transaction. A process will be developed by COMET to address a temporary solution to the identified GAP.

Competitive Meter OwnershipProtocol Changes and Guides(work in progress) • Protocol Revisions • Create PRRs to support competitive ownership • Task Force recommended the addition of the following statement in ERCOT Protocols Section 10 (subject to review by the working group): • Competitive meter ownership is a subset of TDSP Metered Entities, excluding Generation or NOIE metering points. Competitive meter ownership shall meet all the applicable rules in the ERCOT Protocols, including requirements for TDSP Metered Entities and any other requirements as outlined in the Competitive Metering Guides. • Competitive Metering Guides (CMG) • Create and document business process requirements necessary to implement/provide Competitive Meter Ownership

  12. CHARTERin regards to other competitive metering servicesas approved by TAC on March 6, 2003 The Competitive Meter Working Group (COMET) will recommend a market structure and business policies and procedures necessary to implement other competitive metering services.

Other Competitive Metering ServicesRMS Approval – TAC presentation pending • Developed a high level view of a market structure for the introduction of the meter service provider functions as future competitive metering services. The provided market structure could be utilized by the Commission as a foundation for the next phase of rulemaking in the introduction of competitive metering services • June 12, 2003 RMS meeting, RMS approved the future competitive metering services market model (MSP phase) as presented by the COMET WG • Meter installation, removal, maintenance, testing, and calibration • Pending presentation to TAC • Pending PUCT rulemaking process • Market model for competitive metering services for functions surrounding meter reading for the purposes of determining TDSP billing determinants and the submittal of settlement data to ERCOT have been deferred by the COMET WG, per PUCT Staff guidance • Data Collection and Data Management

  20. Competitive Meter Approval Process • New meter is requested for a specific customer’s location. • Application is filed by customer and/or the customer’s meter representative to ERCOT Settlement Metering Group. Document submittals shall include: • Certification of compliance with applicable ANSI standards. • Letter from manufacturer indicating that they will supply free programming software & adequate training to TDSP within 30 days of receipt of meters. • ERCOT reviews the application for completeness, and to determine if information to demonstrate ANSI compliance has been submitted. • If accepted, ERCOT forwards application to TDSP • ERCOT notifies the market of submittal. • TDSPs will test meter using applicable standards and share data with other TDSP’s and ERCOT. Information will be made available to other Market Participants upon request. • ERCOT approves application based on positive recommendation by a minimum of 80% of TDSP’s, otherwise application is rejected. • If approved, meter is added to list. • If rejected, ERCOT will provide TDSP documentation to the applicant of the specific reason(s) for rejection. • Note: Appeal to PUCT is available for all parties. • TDSP’s refers to TDSP’s where competitive metering is available

  21. Meter Issue Resolution Process • TDSP notifies the manufacturer of product issue. • If the product issue involves non-compliance with ERCOT approved competitive meter standards, TDSP shall notify ERCOT of the issue and the manufacturer’s response to the issue. • ERCOT reviews issue. • ERCOT confirms non-compliant product issue. • ERCOT sends a notification to all TDSP's, and to the meter manufacturer, if issue is confirmed. • Manufacturer must resolve issue with TDSP's and ERCOT, during which time further meter installations may be placed on hold. If resolved, remove meter from hold status, and Meter Issue Resolution Process is complete. • If not resolved, ERCOT creates de-certification form based on unanimous recommendation from TDSP’s. • ERCOT removes meter from ERCOT approved competitive meter list. • Note: Appeal to PUCT is available for all parties. TDSP’s refers to TDSP’s where competitive metering is available

  22. ERCOT Competitive Meter Standards • Meter functionality shall meet the latest revision of ANSI standards as approved by ERCOT. All meters shall meet C12.10 and either C12.1 or C12.20, without exceptions. • Meters shall have a minimum of three password levels: a) Programming, b) Read only, demand reset, and time syncing, c) Read only • Meets firmware functionality as defined by ERCOT and as documented by manufacturer. • Meets TDSP billing determinate requirements • Conforms to TDSP meter reading/operating/billing systems • Note: TDSP’s refers to TDSP’s where competitive metering is available

  26. New Market Participant: “METER SERVICES PROVIDER” MSP  • Installation & Removal • Maintenance • Programming, including billing determinants • Testing & Calibration MSP must provide ALL of the above services for a competitively-owned meter to which it is contracted.

Market Characteristics: • Customer choice of competitive metering services remains optional • MSPs will not be required to offer services in all TDSP territories • MSPs will not be required to support all meters on the statewide list • TDSPs will continue to offer advanced metering services per PUCT-approved tariffs, including new installations

Competitive Metering Services -- MSP Phase Competitive MSP market exists PUCT Rule: All competitively owned meters must be contracted to an MSP MSP eligible to enter the Market Owners of competitive meters may acquire meter services from an MSP TDSP provides all meter services Jan. 1, 2004 Preparation Period Transition Period • Completion of MSP rule writing process • Protocol revisions • System changes • Operating Guides development • Certification and qualification of new market entrants (MSP) • TDSP continues to provide metering services for competitively-owned meters in its service territory if customer does not choose to acquire services from an MSP • TDSP metering services shall be limited to competitive meter types installed in the TDSP service territory at the time of transition (“Transition List”), including new installations of those meter types • Competitive meter owners who select a meter not on the Transition List for that specific TDSP service area must acquire MSP services for that meter

  29. Market Characteristics: • TDSPs are the only entities that can connect or disconnect service • TDSPs retain responsibility for instrument transformers (CTs, VTs) and associated wiring and socket • MSP services must be coordinated with the REP/CR • REP/CR must notify TDSP prior to competitive meter installation

  30. Meter Programming: • A single entity (either the MSP or the TDSP) will possess the necessary password to program a meter for billing determinants • Only the MSP or TDSP may program a meter for billing determinants • A third party authorized by the meter owner may reprogram meters for data unrelated to billing as long as proper security protection is assured, based on future COMET recommendations

  31. Market Safeguards: • TDSPs may provide emergency services on any meter in order to restore service or remedy unsafe conditions • Market participants will communicate issues related to meter malfunctions or inaccuracy to the responsible party • Substation access is determined by rules and policies of the substation owner • A service provider selection process needs to be developed for situations when MSPs leave the market

Certification & Compliance of MSPs: • MSPs must be certified to perform competitive metering services in Texas • PUCT is the recommended entity to serve as Certification and Compliance Agent (including financial requirements) • ERCOT may provide technical qualification assistance • Draft of recommended standards has been developed based on the NAESB Uniform Business Practices manual, and other states’ efforts

Key Terms and Definitions: • Market does not currently have adequate definitions for numerous terms related to competitive metering services • COMET WG is developing draft recommendations for standard market terms and definitions • PUCT is urged to include appropriate new definitions in future rulemakings
