  5. 501(c)3 There is no such thing as a 501(c)3 corporation. A corporation is a matter of state law. IRC 501(c)3 is a federal tax law and relates to tax-exempt status. IRC 501(c)3 lists many different categories of exempt organizations. All churches by default are exempt organizations under 501(c)3. Churches may apply for IRS recognition (determination letter) that recognizes the churches tax-exempt status.

  7. How do you keep your church in good standing? File your statement of information!

  8. Why are bylaws so important? The bylaws are the rules of your Corporation. A church must follow their own rules. (bylaws) In litigation, a court will review the bylaws to see if the church has followed their own rules. Make sure your church can live by their own rules. A church can amend their bylaws, if changes need to be made.

  9. Churches should have the following: Some areas of concern A church facility use policy. A formal membership policy. Procedure for member-discipline. Procedure for membership revocation. All job descriptions should explain how the position furthers the mission of the church. Statement of religious belief regarding marriage. A policy of due diligence (background checks) for volunteers and staff who work with children.
