  2. How the law came about

  3. Anacostia River Clean Up & Protection Act (“Bag Law”) All District retailers that sell food or alcohol must charge a 5¢ fee for each paper or plastic disposable bag.

  4. Intent of the law To change behavior vs. generate revenue.

  5. Exemptions • Package bulk items (i.e. nuts, candy, grains, etc.) • Contain or wrap “leaky” foods or items where dampness may be a problem • Contain unwrapped prepared foods or bakery goods

  6. Inspection and Enforcement Process

  7. Where does the nickel go? • Businesses retain $.01 OR $.02 if there is a reusable bag rebate. • Fees deposited into special purpose fund, administered by DDOE.

  10. Outreach • DDOE focused on outreach efforts during the first year after the law took effect.

  11. Is the law working? • 80% of DC residents have reduced their usable of disposable bags since the law took effect. • Residents estimate using 4 bags a week today vs. 10 bags a week before the law took effect.
