  • Constituent des actes de terrorisme, lorsqu'elles sont intentionnellement en relation avec une entreprise individuelle ou collective ayant pour but de troubler gravement l'ordre public par l'intimidation ou la terreur, les infractions suivantes :

  • 1 Les atteintes volontaires la vie, les atteintes volontaires l'intgrit de la personne, l'enlvement et la squestration ainsi que le dtournement d'aronef, de navire ou de tout autre moyen de transport, dfinis par le livre II du prsent code ;

  • 2 Les vols, les extorsions, les destructions, dgradations et dtriorations, ainsi que les infractions en matire informatique dfinis par le livre III du prsent code ;

  • 3 Les infractions en matire de groupes de combat et de mouvements dissous dfinies par les articles 431-13 431-17 et les infractions dfinies par les articles 434-6 et 441-2 441-5 ;

  • 4 Les infractions en matire d'armes, de produits explosifs ou de matires nuclaires dfinies par les 2, 4 et 5 du I de l'article L. 1333-9, les articles L. 2339-2, L. 2339-5, L. 2339-8 et L. 2339-9 l'exception des armes de la 6e catgorie, L. 2341-1, L. 2341-4, L. 2342-57 L. 2342-62, L. 2353-4, le 1 de l'article L. 2353-5, et l'article L. 2353-13 du code de la dfense ;

  • 5 Le recel du produit de l'une des infractions prvues aux 1 4 ci-dessus ;

  • 6 Les infractions de blanchiment prvues au chapitre IV du titre II du livre III du prsent code ;

  • 7 Les dlits d'initi prvus l'article L. 465-1 du code montaire et financier.

  • Le maximum de la peine privative de libert encourue pour les infractions mentionnes l'article 421-1 est relev ainsi qu'il suit lorsque ces infractions constituent des actes de terrorisme :

  • 1 Il est port la rclusion criminelle perptuit lorsque l'infraction est punie de trente ans de rclusion criminelle ;

  • 2 Il est port trente ans de rclusion criminelle lorsque l'infraction est punie de vingt ans de rclusion criminelle ;

  • 3 Il est port vingt ans de rclusion criminelle lorsque l'infraction est punie de quinze ans de rclusion criminelle ;

  • 4 Il est port quinze ans de rclusion criminelle lorsque l'infraction est punie de dix ans d'emprisonnement ;

  • 5 Il est port dix ans d'emprisonnement lorsque l'infraction est punie de sept ans d'emprisonnement ;

  • 6 Il est port sept ans d'emprisonnement lorsque l'infraction est punie de cinq ans d'emprisonnement ;

  • 7 Il est port au double lorsque l'infraction est punie d'un emprisonnement de trois ans au plus.

  • Les deux premiers alinas de l'article 132-23 relatif la priode de sret sont applicables aux crimes, ainsi qu'aux dlits punis de dix ans d'emprisonnement, prvus par le prsent article.

  • The Terrorism Act 2000 1

  • (1) In this Act "terrorism" means the use or threat of action where(a) the action falls within subsection (2), (b) the use or threat is designed to influence the government or to intimidate the public or a section of the public, and (c) the use or threat is made for the purpose of advancing a political, religious or ideological cause.

  • (2) Action falls within this subsection if it- (a) involves serious violence against a person, (b) involves serious damage to property, (c) endangers a person's life, other than that of the person committing the action, (d) creates a serious risk to the health or safety of the public or a section of the public, or (e) is designed seriously to interfere with or seriously to disrupt an electronic system.

  • (3) The use or threat of action falling within subsection (2) which involves the use of firearms or explosives is terrorism whether or not subsection (1)(b) is satisfied.

  • (4) In this section- (a) "action" includes action outside the United Kingdom, (b) a reference to any person or to property is a reference to any person, or to property, wherever situated, (c) a reference to the public includes a reference to the public of a country other than the United Kingdom, and (d) "the government" means the government of the United Kingdom, of a Part of the United Kingdom or of a country other than the United Kingdom.

  • (5) In this Act a reference to action taken for the purposes of terrorism includes a reference to action taken for the benefit of a proscribed organisation.

  • (1) the term ''international terrorism'' means activities that (A) involve violent acts or acts dangerous to human life that are a violation of the criminal laws of the United States or of any State, or that would be a criminal violation if committed within the jurisdiction of the United States or of any State; (B)appear to be intended - (i) to intimidate or coerce a civilian population; (ii) to influence the policy of a government by intimidation or coercion; or (iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping; and (C) occur primarily outside the territorial jurisdiction of the United States, or transcend national boundaries in terms of the means by which they are accomplished, the persons they appear intended to intimidate or coerce, or the locale in which their perpetrators operate or seek asylum;

  • (5) the term ''domestic terrorism'' means activities that - (A) involve acts dangerous to human life that are a violation of the criminal laws of the United States or of any State; (B) appear to be intended - (i) to intimidate or coerce a civilian population; (ii) to influence the policy of a government by intimidation or coercion; or (iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping; and (C) occur primarily within the territorial jurisdiction of the United States
