Flexibility Options With the availability of Title 20 waiver flexibility such as Investing in Educational Excellence (IE2) and Charter Systems, Georgia has encouraged local school systems to seek waivers from Title 20 statutes in order to exercise flexibility that will enable innovation and reallocation of resources in exchange for increased student achievement. Additionally, the Georgia General Assembly established June 30, 2015 as the deadline for each school system to declare its intention to be a flexibility school system (through the use of Title 20 waivers) or a status quo school system. Until or unless several provisions within Title 20 are repealed or amended, the flexibility options for waiving Title 20 statutes will remain tied to the legal and administrative process that flows through the local school board, the Georgia Department of Education and ultimately to the Georgia State Board of Education.

  3. Flexibility Options Title 20 does not limit the flexibility mechanism options to IE2 and Charter Systems. For example, if a school system decided to convert all its schools to charter schools, the resultant system of charter schools would satisfy the desire to maximize school flexibility. In addition, another flexibility option is available to school systems that exchanges Title 20 waivers for improved student outcomes. This new operational system option is called Strategic School System.

  4. Strategic School System The Strategic School System option is a new operational system that would provide another means to achieve the mandate to seek flexibility by 2015. Strategic School System would allow school systems to “bundle” waivers to allow flexibility from Title 20 that is linked to a strategic plan that increases student achievement accountability. This would provide another flexibility option for school systems and encourage school systems to contemplate all requests for waivers within the context of a strategic plan that will result in higher levels of student achievement.

  5. Selecting an Operational System • Per OCGA §20-2-84.3, by June 30, 2015 each local school system must choose to operate as one of the following: • Investing in Educational Excellence School System (IE2) • Charter System • Status Quo School System • Other options include: • Strategic School System • System of Charter Schools
