    3. 1.1 BACKGROUND Failure to be informed at the first time followed up with prompt handling of any major traffic accident will result in significant loss of lives and properties of the people, and affect the safety of transportation and communications as well as their use efficiency. Whereas tourist bus is one of the important transportation means for land public transportation, its safety control also presents a topic highly concerned by the general public. However, traffic accidents of the tourist buses have been consecutively reported and blamed for causing major traffic accidents. While expressing their concerns over the major causalities reported in traffic accidents of tourist buses, the genera public urges the government to mobilize its optimal resources to support the rescue and medical care of the injuries, and further demands the clarification of the causes of traffic accidents and corrective action for the safety issues of tourist buses to avoid repeated occurrence of the similar accidents.

    6. 1.3 CASE & PROBLEM ANALYSIS (2) Drive Safety Control Problems Other than requirements on the exit door and fire extinguisher, there is the absence of any other laws and regulations prescribed for safety requirements on tourist bus in Taiwan. For considering the safety of the general public, it is necessary to develop related laws and regulations to demand the tourist bus owners to provide protection for the safety of the people. It is urged to improve the emergency response competence of the on-board service crew to help evacuate the passengers and the propaganda of escape concepts for the passengers. In terms of the gravis extent of any traffic accident involving tourist bus, the rescue comes more important than other types of vehicles involved while the better rescue efficiency can only be achieved by the positive involvement of the tourist bus owners.

    7. 1.3 CASE & PROBLEM ANALYSIS (3) License plate for tourist bus had been frozen since November 1977 to prescribe the reorganization action. However, the long-term frozen license plate has resulted in problems of the soaring price of license plate in the black market, and those derived from the illegal operation of carrying tourists by self-provided non-commercial buses. The ban was lifted on and after September 24, 1991 by the introduction of “Tourist Bus License Plate Application Option to request all tourist buses shall all apply for the license plates. Accordingly, the operation and control of the passenger transportation by tourist buses has been re-directed under the control of the existing legal requirements. Currently, there are four operation types of passenger transportation by tourist buses, respectively as follows: To be leased by travel agency to undertake the package travel transportation operation; To be contracted by individuals or groups to undertake travel or communications and transportation operation; To exclusively undertake the commuting service contracted by an institute or organization; and To provide illegal highway scheduled bus service.

    11. 1.5 SOP (1) 1.5.1 Scenario This SOP has been essentially developed for the management of traffic accidents involving land public transportation vehicles. The scenario describes a certain tourist bus on its way for the scenic spot of LiShan in Nantou County was passing through Section Kunyang of Provincial Highway 14 Line A, the failure in braking caused the bus to turn over, fall into a valley and was in a fire resulting in the casualty of ten died and 36 injured. This major accident requires trans-department joint rescue and support, a proper response management mode is provided by the SOP for all salvation units to prevail their optimal and most efficient emergency response competence.

    13. 1.5 SOP (3) 1.5.2 Laws & Regulations (2) Central Hazard Response Center Operation Guidelines MOTC hazard emergency notification operation guidelines To control time efficiency, MOTC and its agencies upon being notified of the occurrence or suspected occurrence of hazard shall promptly verify the hazard, take necessary responsive action, confirm the nature and scale of hazard, notify the superior agency, and notify all agencies (units) concerned. In case of any hazard of Scale B and above, notify via phone and fax. Upon being notified, MOTC multiple notification supplementary window shall relay the same to the MOTC regulating authorities for handling. Subsequent notification: before the creation of a response unit, the notification shall be transmitted once every four hours to facilitate controlling the hazard and in-time response unless otherwise specified with the exception that for any major hazard, it shall be controlled and reported to or as required by the superior agency. Traffic accident on highway: whenever the casualty ranging between 3 and 9 to comply with Scale B hazard resulted from any (1) highway traffic accident or (2) highway traffic hazard, it shall be reported to the regulating authorities of the Central Hazard P&S operation and MOI Fire Department.     15. 1.5 SOP (5) 1.5.2 Laws and Regulations (3) Fire Act: hazard salvation and emergency help Hazard salvation: Chapter 3 of Fire Act provides requirements of hazard salvation and each level of fire agencies shall create and maintain hazard salvation and help command center. Emergency help: upon receiving the application for emergency injury help or being informed of any emergency, the fire agency shall confirm the site of the accident, number of patients pending medical help and gravis extent of the accident, and immediately assign the crew as required to the site. In providing the emergency help, the crew shall exactly follow the items, scope and operation procedure specified by the health regulating authorities. First Aid Act: first aid First Aid System: As provided in Chapter 2 of First Aid Act, a first aid command center shall be created in the fire agency. First Aid Operation: As provided in Chapter 5 of First Aid Act, any municipal government in case of any accident or hazard involving massive patients within its jurisdiction, shall create a site command and coordination system depending on the scale and type of hazard to provide first aid related works. In case of massive patients, all the site first aid crew and any institute with self-provided ambulance shall operated according to the assignment of the site command and coordination system.

A major road traffic accident relates to either of the following events:Three or more than 3 people are killed, or the casualty mounts up more than 10 people, or not less than 15 people are injured in the accident; orAny explosion and/or combustion to the hazardous substance, or any leakage of toxic gas/liquid, or radiant substance in transit.     22. 1.5 SOP (12) 1.5.4 Accident Salvation Units (Roles and Functions of other Units) Traffic Control Unit Any Highway Traffic Accident, i.e., any major car accident on the highway wherein victim (s) is pending rescue or the highway is found one-way or two-way interrupted shall be reported to the Road Safety Commission and the Traffic Mobilization Commission. Any Highway Traffic Hazard, i.e., any major hazard on the highway resulting in interrupted traffic and victim (s) is pending rescue or the traffic is serious affected shall be reported to the Road Administration Agency and the Traffic Mobilization Commission.     24. 1.6 SUPERVISION & PERFORMANCE EVALUATION(2) To improve the prevention of traffic accident of tourist bus, the owner of the tourist bus and the agencies concerned in the government shall respectively carry out the following undertakings: 1. Tourist Bus Passenger Transportation Industry Development and maintenance of systems for vehicle service, driver control and itinerary planning, followed with periodical check up. 2. Traffic Regulating Authorities: Improve following through inspection of tourist bus periodically and from time to tome, publish the locations of the road where are vulnerable to car accident and present higher risks, and establish integral travel road network information system. 3. Police Administration Regulating Authorities: Site control and exhibits collection. 4. Fire Regulating Authorities Provide site first aid and send victim (s) to hospital. 5. Health Regulating Authorities: Activation of first aid network.

    25. 1.7 Expected Objectives & Visions Whereas prevention and salvation of traffic accidents rely upon the full cooperation among all agencies concerned in the government, each agency while improving the propaganda for traffic safety shall within the scope of its functional authorities provide sufficient preventive action and training of crisis response and management so to come up with fast and well practiced salvation works in case of any accident. Therefore, while developing sound communication channels and improving training and education, each agency shall fight for the golden first time in rescue to minimize the casualty of the people.

    27. 1.4 Control Strategies (1) 1.4.1 5. Supervise the tourist bus passenger transportation industry owners to follow through safety control: (1) Specification and safety equipment of the vehicle shall follow traffic safety rules and the model certified by MOTC in the building of the body and the installation of safety equipment. (2) The vehicle shall be maintained according to the mileage specified by the genuine maker of the vehicle and the maintenance shall be documented, particularly on the service of the safety mechanical parts. (3) Follow through the safety checkup and alcohol test to each driver before each assignment. (4) In the planning of itinerary shall be coordinated with the leaser particularly on details of the road condition and safety to permit sufficient rest for the driver on the entire trip. (5) Have proper attention to the mental and physical status and family condition of each driver, and provide annual physical checkup including screening test of urine and blood. (6) Provide safety education and emergency response sufficiency for the drivers. (7) In sharing the driver accident risks, the part of non-compulsory insurance, such as traveler safety insurance or the third party liability insurance, shall be addressed. (8) Have a serious review of the risks of license escrow practice. If the escrow company is willing to accept this practice and is capable of following through the control of the vehicle owner, driver and the vehicle, this practice offers the advantages of expanded business scope, reduced operation cost and improved operation results.

    28. 1.5 SOP (Accident Occurrence & Recognition) Phase One: Accident Occurrence & Recognition The accident is reported by the person concerned (the driver or any passenger) to the local police station, precinct duty center, police dispatch center or traffic squad branch via communications equipment. Bystander is requested to report the accident. The accident is reported through the automatic detector (including the use of CCTV, vehicle detector, and hazard detector technologies), and the application of car fleet service center.

    29. 1.5 SOP (CONFIRMATION OF REPORT) Phase Two: Confirmation of Report The official attending the report of accident shall pool the information collected from the stand-by, and patrol policeman to confirm the accident and enquiry of the ID of the one reporting the accident. If the driver responsible for the accident reports the accident, enquiries shall include the name and address of the driver, the type of vehicle his/she is driving, location of the accident, profile of injury and the side of the accident. If the victim or stand-by reports the accident, enquiries shall include the name and contact number, location of accident, profile of injuries and the site of accident.

    33. 1.5 SOP (TRAFFIC CONTROL, LOCKOUT & EVACUATION) Phase Four: Traffic Control, Lockout & Evacuation Traffic Control and Lockout Keep the control area to the minimum as applicable, and never lockout the entire road unless necessarily Lock out the site of accident to facilitate rescue and protect the safety of the people and vehicles; unless otherwise specified, the lockout line extends for 30~100 M to the rear of the accident site. Start the lockout outside in; and remove the lockout inside out. Provide lighting facilities and alarm lights for the lockout provided during night hours. Site Protection Alarm signs and traffic conics shall be provided at a proper spacing in the rear of the accident site to separate and control car lanes. Designate officials to command the traffic control for preventing the bystanders from watching or entering into the control area. Always mark the location of the vehicle, properties and other evidences left on the site before removing it. Any properties found on the site shall be counted by the site salvation crew and put into bags to be kept by the official of the workstation. Provide emergency light on site during night hours to protect the safety of the exhibits on site and the safety of site management crew. When a provisional traffic control is exercised on the site of traffic accident, the management crew shall report the road condition to the duty command center for broadcasting purpose.

    34. 1.5 SOP (MEDICAL CARE FOR THE VICTIMS) Phase Five: medical care for the victims (Fire and Medical Care) Notify the fire department and hospital to speed to the site for salvation. Ask any vehicle passing by to help send the victim to the hospital and document the license plate number of the vehicle and the name of the hospital; proper first aid shall be provided to the victim to prevent further deterioration of the wounds. Cover up any body and report to the prosecutor for inspection. Immediately identify the dead and the injured while notifying their families to the hospital. The commander at the accident site shall always help in the manpower and facilities coordination, control information required and keep close liaison channels.

    35. 1.5 SOP (accident disposition & helps for the victims) Phase Six: Accident Disposition and Helps for the Victims Accident Disposition Upon receiving the notification, the management crew from the police unit shall carry the complete duty gears to speed to the site, and have the rescue of the injuries as top priority. Park the car at where appropriately upon reaching the site and turn on the light to warn the people and vehicles approaching the site. The duty center shall at any time keep well facilitated liaison channels with each and all salvation units; conform the development of the accident and inform the in and out routes for the ambulances and other vehicles involved in the rescue operation. Soonest notify the highway regulating authorities for them to send officials to the site for disposition. In case of any dead on site, notify the criminal police and the prosecutor of the district court to handle. The director of the regulating authorities shall be also notified to the site for handling while the local car accident investigation commission shall be notified to the site for survey. Helps for the Victims The commander of hazard salvation operation shall confirm the location and condition of any victim in distress, carefully search for any injured or dead on site, and manage to promptly send the injuries to hospital. The local government shall help in routines of help, rescue and sending regards to the injuries and the families of the dead and/or missing person.

    36. 1.5 SOP (RESTORATION & RECONSTRUCTION) Phase Seven: Restoration & Reconstruction The accident site commander shall confirm the site restoration, compiling the list of the casualty, confirm the conditions of gears, vehicles, scattered objects, control signs and markers, and notify the Emergency Response Center. Damages to the innocent shall be reimbursed pursuant to applicable provisions set forth in “Mandatory Car Liabilities Insurance Act” and “Procedure of Sum of Damages & Medical Subsides Payment by Automobile Transportation Business Owners”. As for the damages to the public utilities of transportation, financial institute shall be coordinated to apply the loans for the restoration with incentives including financing, low interest rate for equipment restoration funds. Public works unit shall survey the damage to the transportation facilities, clear of objectives scattered around or barriers on the road while soonest completing the restoration works to the traffic transportation systems including highway and bridge. The information agency shall take advantage of the mass communication media to have intensive report on the news related to the restoration and reconstruction efforts after the land traffic accident.
