Jose Mendez, 50, entered the pleas to charges of bribery, procurement fraud and conspiracy to commit bribery and procurement fraud. Mendez was originally charged in an indictment returned by a federal grand jury Oct. 12. Also charged were Sylvester Zugrav, 68, and Maria Zugrav, 66, owners of Atlas International Trading Company in Sarasota, Fla. The Zugravs are each charged with bribery and conspiracy to commit bribery and procurement fraud. Their cases are pending. Mendez was a program manager for the U.S. Air Force Foreign Materials Acquisition Support Office at Hill, which purchases foreign military materials for U.S. military divisions. One of the vendors allowed to contract with FMASO is the Zugravs' corporation, Atlas. Between 2008 and last August, the Zugravs bribed Mendez to ensure Atlas had favorable treatment over other vendors in the sale of the foreign materials. This would include Mendez disclosing confidential information about the government budget and competitor bid information to the couple so they could win, which Mendez has now admitted to, according to a joint news release by U.S. Attorney David B. Barlow, of the District of Utah, and Assistant Attorney General Lanny A. Breuer, of the Justice Department's Criminal Division. The Zugravs offered Mendez a total of approximately $1,240,500 in payments and other enticements, according to the indictment. Sylvester Zugrav gave Mendez money through FedEx shipments of $5,000 and in person, according to the indictment. At the couple's request, Mendez also had his cousin in Mexico open a bank account, so the Zugravs could send him larger amounts of money without arousing suspicion. Altogether, the Zugravs actually gave Mendez $185,000 in payments and other valuables to date, which Mendez has also admitted receiving, along with promises of additional bribe payments if Atlas were to receive future contracts from the U.S. government. Investigators suspect Mendez showed favorable treatment to Atlas on five occasions in return for the bribes. The Zugravs and Mendez corresponded via email and "took steps to conceal their activity, using covert email addresses, password-protected computer documents, code words and false names," according to the charges. Within the encrypted documents, Mendez adopted the name "Chuco" and Sylvester Zugrav used the name "Jugo," and they referred to cash as "literature." Mendez faces up to 25 years in prison and more than $750,000 in fines, as well as "forfeiture of his ill-gotten gains," according to the news release. His sentencing set for 2:30 p.m. Feb. 21. The case is being investigated by the FBI and the Air Force Office of Special Investigations. The case is being prosecuted by Justice Department Trial Attorneys Marquest J. Meeks and Edward P. Sullivan, of the Criminal Division's Public Integrity Section, and Assistant U.S. Attorney Carlos A. Esqueda for the District of Utah.
