Background for CASR Part 146 • Currently CASA issue CAR 30 Certificate of Approval for organisations to carry out design activities; and appoint individuals as authorised persons to approve designs: • modification and repair designs under CAR 35 • changes in type design, type design data and design data for APMA parts under CASR Part 21 • CASR Part 146 is being developed under the CASA Regulatory Reform Plan to provide the rule for delegation of design approvals.

Part 146 Engineering Representatives • Provide rule for certification and operation of ERs • Two types of ERs: • Individuals – called Designated Engineering Representatives (DERs) • Organisations – called Organisation Engineering Representatives (OERs) • Holders of an ER certificate are delegated the power to perform design approval functions in accordance with the ER certificate

Functions delegated to ERs • Make findings of compliance with applicable airworthiness standards • Approve technical data • Approve use of materials, processes and parts • Approve changes to AFMs • Approve minor changes to type design • Issue modification/repair design approvals • Issue limited STCs (restricted to OERs)

Core DER qualifications and experience • Qualification eligible for graduate member of IEAust, or knowledge and experience acceptable to CASA • At least 8 years relevant experience - each year of completed tertiary course, up to a maximum of 4 years, taken to be 1 year experience. • Thorough knowledge of CASRs and related materials • Familiar with CASA procedures for issuing design approvals • At least 12 months working experience with CASA on aircraft certification matters in the last 3 years

Designated Engineering Representatives • A DER can only find compliance to airworthiness standards within engineering specialties specified in his/her DER certificate. • A DER must have a Procedures Manual to include procedures for: • Independent checking of compliance data • Classification of major/minor modifications and repairs • Liaising with and reporting to CASA • Document and record control

Organisation Engineering Representatives • OERs provide a system approach to delegation of design approval for manufacturers, design and maintenance organisations. • OERs must have suitable organisation and personnel: • Head of Design Approval • Authorised Representatives (ARs) • OERs must have additional systems and procedures: • Selection and appointment of ARs • Internal audit • Training

  11. CASR Part 146 Status • Development and consultation on Part 146 completed early 2006. • Due to other legal drafting priorities, final regulations not available until end of 2007.

  12. Certification Delegation Initiatives • Apply Part 146 requirements to new authorisations or additional scope to existing authorisations. • Standardise scope and conditions specified on instruments. • Change authorised person’s Procedures Manual to improve design approval process and compliance documentation. • Increase use of delegates for finding of compliance with airworthiness standards for type certification, STCs and APMAs.

Delegation Initiatives • Use risk-based audits. • Improve communication with delegates - next Certification and Manufacturing Seminar planned for 14-15 November 2007 in South East Queensland • Work with external providers to provide training – e.g. RMIT Design Approval and Airworthiness Regulations course • Develop advisory materials on design approval procedures and documentation.
