  3. Injuries caused by needles and other sharp instruments, with the subsequent risks of infections, are one of the most common and serious risks to healthcare workers in Europe and represent a high cost for health systems and society in general.

  4. Existing EU legal framework: Framework Directive 89/391/EEC and Directive 2000/54/EC on the protection of workers from risks related to exposure to biological agents at work

Biological risks due to sharp injuries: a new EU Directive adopted by the Council on 10 May 2011 and published in the Official Journal of the EU on 1 June 2010:Council Directive 2010/32/UE Implementing the Framework Agreement on prevention from sharp injuries in the hospital and healthcare sector concluded by HOSPEEM and EPSU

  7. European Parliament Resolution on protecting Healthcare Workers from blood-borne infections due to needlestick injuries of 6 July 2006:The EP called on the Commission to submit a legislative proposal for a Directive amending Directive 2000/54/EC (biological agents at work)

  8. The European Commission consulted the EU Social Partners: • Possible direction of Community action • Content of the proposal • Wish to initiate negotiations in view of a European Agreement • A technical seminar was organized

  9. November 2008: HOSPEEM (European Hospital and Healthcare Employers’ Association) and EPSU (European Federation of Public Services Unions) informed the Commission of their intention to negotiate a framework agreement on the prevention from sharp injuries in the hospital and healthcare sector.

  10. On 17 July 2009 EPSU and HOSPEEM signed a ‘Framework Agreement on prevention from sharp injuries in the hospital and healthcare sector’.

  11. The Framework Agreement aims to: • Achieve the safest possible working environment for employees in the sector • Prevent workers’ injuries caused by all medical sharps • Protect workers at risk and • Set up an integrated approach establishing policies in risks assessment, risk prevention, training, information, awareness raising and monitoring.

  12. Content of the Framework Agreement (1): • Purpose • Scope • Definitions • Principles • Risk Assessment • Elimination, Prevention and Protection

  13. Content of the Framework Agreement (2): • Information and Awareness-raising • Training • Reporting • Response and Follow-up • Implementation

  14. EPSU and HOSPEEM requested the Commission to submit the Agreement to the Council for a Council decision, in accordance with Article 139(2) of the EC Treaty with a view to give legal effect to the Framework Agreement.

  16. Council Directive Implementing the Framework Agreement concluded by HOSPEEM and EPSU: • Makes the Agreement legally binding across the European Union • Lays down the rules on penalties applicable to infringements • Enter into force: three years after adoption

  17. Next step: facilitating the effective implementation of the new Directive, involving all the stakeholders

Conclusions: • The new Directive is a real breakthrough in the prevention of sharp injuries. • The new Directive Implementing the Agreement aims to make it legally binding across the EU. • The challenge now is the effective implementation of the Directive. • Key role of all the players in the hospital and healthcare sector.
